AN ORDINANCE TO REPEAL ORDINANCE NO. 1703 AND FOR OTHER
PURPOSES.
WHEREAS, Ordinance 1703 of the City of West Memphis was
adopted by the West Memphis City Council for the stated purpose of
establishing the Utility Department commission and repealing all
conflicting ordinances; and
.. WHEREAS, Ordinance 1703 has been held in abeyance by the
timely filing of a referendum petition; and
WHEREAS, previous efforts to modify or abolish the West
Memphis Utility Commission as created by Ordinance 1069 have also
been submitted to the citizens of West memphis pursuant to
referendum petitions and soundly defeated by the voters; and
WHEREAS, the effort to abolish the West Memphis Utility
Commission by Ordinance 1702 was defeated by over 800 of the voters
in the special election held January 9, 1996; and
WHEREAS, the citizens of West Memphis have spoken loudly and
clearly against fundamental changes to the West Memphis Utility
Commission; and
WHEREAS, the fundamental structure of the West Memphis Utility
Commission should remain as established by Ordinance 1069; and
WHEREAS, Ordinance 1703 should be repealed immediately to
comply with the mandate of the citizens of West Memphis and to
prevent the unnecessary expense of another special election;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS, THAT:
Section 1. Ordinance 1703 of the City of West Memphis is
hereby repealed.
