AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR A PART OF LOT 3
OF DACBRA SUBDIVISION LYING WEST OF INGRAM ROAD AND NORTH OF
BROADWAY CONTAINING 5.23 ACRES, MORE OR LESS WITH A COMMON ADDRESS
OF 398 INGRAM ROAD, WEST MEMPHIS, ARKANSAS, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS, application was to the City Planning Commission of West
Memphis, Arkansas to allow a Special Permitted Use of the hereinafter
described lands for the development of an Elderly Apartment Complex, as
required by Ordinance 1258, as amended; and
WHEREAS, Notice of said hearing has been published for the time
and in the manner as provided by Ordinance 1258, the matter was heard
by the City Planning Commission at the August 28, 1996 meeting and upon
the matter being heard by the City Planning Commission and further
consideration thereof the City Planning Commission recommended that
said Application be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property to wit:
Common address: 398 Ingram Road
Legal Description: A 5.23 acre site being a part of Lot 3 of Dacbra
Subdivision to the City of West Memphis as shown
by plat recorded in Plat Book 3, Page 306, in the
office of the Circuit Court Clerk & Ex-Officio
Recorder of Crittenden County, Arkansas, and being
more particularly described as follows:
Beginning at a point on the West line of said Lot
3 that is N00°40'00"E and 248.00 feet from the SW
corner of said Lot 3, thence continue N00°40'00"E
a distance of 258.38 feet, thence N74°54'00"E a
distance of 291.83 feet, thence N88°20'00"E a
distance of 405.57 feet, thence N81°45'31"E a
distance of 318.67 feet to a point on the West
right-of-way line of Ingram Blvd., thence
S00°30'00"W a distance of 60.0 feet, thence
S81°45'31"W a distance of 290.0 feet, thence
S00°30'00"W a distance of 230.7 feet, thence
N89°21'00"W a distance of 359.0 feet, thence
S00°30'00"W a distance 67.0 feet, thence
N89°21'00"W a distance of 358.13 feet to the point
of beginning.
be and the same is hereby granted a Special Permit Use allowing and
permitting the use of the above described property for the development
of an Elderly Apartment Complex to be constructed thereon in a C-2 Open
Display Commercial District.
SECTION II: That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION III. EMERGENCY CLAUSE. It is found and declared by the
City Council of the City of West Memphis that this Elderly Apartment
Complex is needed by the community to provide decent housing for
elderly residents due to a demonstrated need based on census data and
that the funding for this development expires on September 30, 1996 and
if special use is not granted by this date, that construction of this
development is highly unlikely and therefore this ordinance must be
effective immediately. It is recognized by the community that elderly

;housing is necessary for the safety, health, protection, and welfare

of the citizens of West Memphis, therefore an emergency is hereby
declared to exist and this ordinance shall be in full force and effect
from and after its passage and approval.
