Thereupon, },4r. Thompson was introduced and advised t},ose present of the
fellow2ng facts:
°Pa[id5outh Gas Oornpany was inrcrl>orated July 10, 1950 under the laws
qi' the State of Arkansas.
On July 11, 1950, P;IidSouth Gas Com}vary- riled with the Arkansas Public
Service Commission its application for (a) Approval of its plan of
organization to operate as a public utilit~r in Arkansas; (b) A
certificate of public convenience and necessitry to construct, maintain,
and operate natural gas facilities to serve the follnwi_ng towns in
Easterr_ Arkansas: Brinkley, '1'urrell, Cotton F'lant, Crawfordsville,
Earle, Forrest Cit;,*, Hughes, Lepanto, I~iarianna, Plarion, Narked Tree,
Palestine, Paragould, Parkin, Tyronza, `Puckerman, }nest Helena,
}Vest Id:emphis, tidheatley, and Wynne.
By order of the !lrkansas Public Service Covmmission, a hearing was
held on the application of MidSouth Gas Company on July 20, 1950
and its order approving the application of 1~IidSouth Gas Company
was issued on the 21st day of July, 1950.
Cn July 19, 1950, MidSouth Gas Company filed its application with
the Federal Po,-,er Commission for a certificate of public convenience
and necessity for the construction of transmission and distribution
systems in the counties of Greene, Poinsett, Crittenden, St. Francis,
Lee Phillips, B4onroe, tidoodruff, and Cross, Arkansas.
The above application vvas to cover all the proposed expansion of
},IidSouth Gas Company, including the acquisition of Helena, Arkansas
and the construction oi' a lateral line to Helena, Arkansas.
The above filing witYv respect to f;as supply was based on letters and
telegrams of intent from Texas Gas Transmission Corporation wherein
they agreed to supply, suoject to the approval of the Federal Poyver
Conmrission, the gas requirements of the cities and tovvrrs to be served
from that source of supply.
It became apparent after discussions v+ith tyre Federal Power Conmrission
drat only 5,000,000 cubic fee of gas per day would be availae~le from
Texas r:,as Transmission Corporation unless that Company constructed
additional facilities, for which it has not filed application 5aith the
Corrunission. S,000,OOU cubic feet of gas per day vaas sufficient to serve
the requirements of the city of Helena, only and therefore on plovember 3,
1950, IdidSouth Gas Company filed a separate application with the Federal
Power Commission for a certificate of convenience and necessity to
construct facilities to the City of Helena, Arkansas.
Due to emergency conditions in Helena, in December, 1950 with respect
to the supply of propane gas, the Federal Pov+er Conunission issued a
temporary certificate of convenience and necessity to MidSouth Gas
Company on December 19, 1950, and ti,ereafter on February 20, 1951
issued a permanent certificate of convenience and necessity with
respect to the stg~ply of gas to Helena, Arkansas. These matters were
considered under Docket No. G-1527•
The Federal power Conuni.ssion on July 25, 1951 issued its order consoli-
dating the hearings in Docket No. G-11,15 arrd llocket A}o. G-160 acrd set
August 27, 1951 as a hearing date.
The hearings were concluded en August 29, 1951. On Uctober 30, 1951
the Staff of the Co~:utrissi.on filed its recorm?endations.
f~~,J
Tyre proposed findings recorm~rended by the Staff of the Commission, continl-ent
upon 2:iid~outh Gas Companyrs receiving an adequate supply of gas, in Docket
No. G-1578 (now in hearing vutdex' Docket 210. G-181;7) and Docket Ito. G-1693
that the construction, acquisition. and operation of the proposed faa.lities
and the transportation of natural gas thereby are required by the public
convenience and necessity and certificates therei'or should be issued.
Pursuant to the letters and telegrams of intent from 'Pe::as Gas Transmission
Corporation, that ComY~any filed an application v+ith the Federal Pot^;er Commission
on January 3, 1951 for a certificate a,_tthori~ing the construction of ceri,ui.n
new facilities and for authority to deliver additional quantities of gas to
MidSouth Gas Company for service to certain cities and towns in Arkansas,
including +~es-t. Y;Iegtphis and Iliarion.
By order of the Federal Power Commission, a hearing nn the a}~plication of Texas
Gas Transmission Corporation was commenced on 2,iay 2u, and after tt8 sessions was
concluded on August 16, 1951. The above matter v+as heard rtnder Docket No. G-1578.
2iidSouth Gas Company intervened before the Federal Power Cormmission in these
hearings and pr~ ented testimony v+ith respect to its gas requirements.
On 2lovernber 6, 1951, the Federal power Conuni.ssion issued its order denyir~ the
application of Texas _?as 'Prarrsmission Oorporation in Docket, No. G-1578 but
specifically stating that the denial v;as witfrout prejudice to 'Pexas Gas
Transmission Corporationrs filing a new application vaith respect to such.
facilities.
The reason the federal io~aer Corm•riUsion rave for denying; this application was
that the :;ale to Tennessee Valle;,r Authority of some ninety million feet of
I-as in their new steam plant:. zdas not in the public interest, as coal ~,+as
available at the site oi' this nevi plant in lar;e quantities.
Cn December 3, l:?51, 'Pexas Gas `Pransmis::,ion Corporation filed a nevv appl~_cation
with the Federal Power Cor!unission in Docket 210. G-18117 vdherein they proposed
to enlarge their i'acilities acrd requested authorityy= to c}eliver to 2;iidS~uth Uas
Company, among others, its a~as requirements for service to certain cities and
tovvrrs in Eastern Arkansas.
On January 22, 1952, apre-hearing conference was held in the hearing room of
the Federal Fower Commission, t:he purpose of which d~as to expedite the hearings
involved in the new applic-ation of 'Pexas Gas Transmission Corporation. The
pre-hearing conference was1.at.tended by a IgidSouth Gas Company representative.
On February 6, 1?52, the ~~ederal Power Commission issued an order settinp_ February
26, 1952, as the date upon vahich hearings would begin on the application of Texas
Gas Transmission Corporation.

August 4, 1.952, coni'erenre between IQid$outh and Federal Power Conunission Staff
in connection with I,kidSouth certificate case for August 2Uth hearing in order
to bring this case up to date after the long delay in allocation cases.
August 22, 1952, P~iidSouth filed brief on foivaal hearing of I~keral Povaer
Commission held on t'lur;ust 2(}th.
Un Selaeraber l.u, 1952, Federal Potrer Ca uission granted I,IidSouth its
rertificate contingent rti>on ironing out certain. contractual conditions
having to do with hrkansas F'ovrer u Li;ht and '1'eaas Gas 't'ransmission
Corporation within si:cty days. T;"idSouth, under this conditioned order, was
alloyed to proceed with construction of the towns to be served from the
existing line from Helena to 'irl<ansas Pot+er £~ L.i~;ht F'lant at Forrest City
and certain towns served (rota 'texas Eastern Transmission Corporation.
Texas Gas Transmission Corporation has advised T,k:LdSouth ttrat they have
enough. gas now to supply these tovrns in the southern group this vainter and
that they are now 1a;~ing another line that vai11 make „as available to
~J'Jest T:1,emphis, Taiarion, etc.. in 1953.
I,gidSouth has commitment from mills for the heavy wall pipe that goes in the
k.Rississippi }?fiver crossinr~ and about one-half of the pipe that goes in the
line from Texas Gas 'k'r•ansmission Corporations s main line to Vilest T:(emphis
for delivery in second quarter of 1953 contingent arson allocation of this
steel tonnage by Petroleum Administration for Defense in Washington which we
expect to %et within the next month.
As near as we can tell now the balance of pipe for line from '}'eras Gas
Transmission Corporation to iJest k:lcnrphis will be available in third quarter
of 1953. All pipe, regulators, meters, etc. i'or the distribution systems at
}rest T~4emphis and T;iarion are on hand arxl have been for some time.
It is impossible to get the river crossing in at 'cJest I;ientphis d using 1952.
It is usually about August :ach year before the river is in condition to
cross with pipeline.
It is T~~iidSouth's intention to cross the Mississippi River to Vilest iietnphis and
1'.iarion in late-swtuner of 1953 and do its dead leve]_ best to serve ,;as to
West I:i~~mphis and T;ar:Lon during; the hea.ting~ season o£ 1953.
MidSouths s franchises at aJest T;}emphis acrd I;Iarion are -tied to date of granting
by Federal power Commission of certificate. Throu.^h no fault of T;Iid:iouth it
has been found t},at due to the shortage of heavy vrall spc;cial pipe and also oi'
the size that it takes i'or the line from Texas Gas Transmission Corporation
I,IidSouth will be unable to rsac}t lJest ?,terrphis and T,arion unti]_ 1953, therefore,
v:e think it best to extend :rlidaouthss franchises until the fall. of 1953.
p;[id;;outh has the allocation of gas that vrill be available in 1953. 't'he
allocation is not transferable, also there is no other company who can Fret
a gas allocation from Federal Poower Cununission for Vilest h~Ieniphis and ?'4arion.
This Commission has satisfied itself that T4idSouth is in financial position
to go ahead vrith the construction in 1953 and that they intend to carry out
their oblif;ation of serving West }:~tetrphis and 1larion with natural gas in 1953.~~
