AN ORDINANCE TO AMEND ORDINANCE 1258 REGARDING ZONING
REGULATIONS FOR THE CITY OF WEST MEMPHIS, ARKANSAS.
WHEREAS, the Planning Commission of the City of West Mmephis, Arkansas, has
prepared amendments to Ordinance 1.258, which adopted zoning regulations and an official
zoning map for the City of West Memphis, Arkansas; and
WHEREAS, not fewer than three (3) copies of said amendments to Ordinance 1258 have
been on file in the office of the City Clerk in the West Memphis City Hall and will continue to be
on file at all times for public inspection and review; and
WHEREAS, after a public hearing upon due notice and publication, pursuant to Article
V, Section 21, Paragraph A-1; Article II, Section I and Article III to include (CV) Conservation
District to the zoning regulations adopted by Ordinance 1258, the Planning Commission has
approved and recommended for adoption the proposed amendments of the zoning regulations
adopted by Ordinance 1258;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
section 1. Article V, Section 21, Paragraph A-1 of the zoning regulations adopted by
ordinance 1258, as amended, is hereby amended to add the following:
That business property with frontage on both sides of Broadway Avenue from the east right-of-
way line of Missouri Street extending east to 14th Street and the business property with frontage
on both sides of Broadway Avenue from the west right-of--way line of Missouri Street extending
west to Rhodes.
Section 2• Article III, of the zoning regulations adopted by ordinance 1258 is hereby
amended to add, Section 5, Conservation Zoning District:
A. general Description -This district is intended to conserve agricultural land and
natural amenities. The function of this district is to prevent development that is incompatible with
farm land or undeveloped areas. The type, area and intensity of uses permitted in this district are
designed to protect such areas. Uses fall into three categories those which are not allowed; those
that are permitted uses by right and those that are special permitted uses.
B. Permitted Uses -The permitted uses in the Conservation District are set for below.
An (X) symbolizes that a particular use is permitted subject to: (1) the provision of off-street
parking; (2) conformance to the special conditions applying to certain uses as set forth in Article
V; and (3) the provision ofoff-street loading in accordance with Article VI, Section 2. The letters
(SP) signify a use that requires a special use permit and all requirements therefore as outlined in
Article IV.
