Arkansas Re: 1^en PSle Bayou Project Gentlemen: It appears obvious that certain o£ the right o£ way necessary for the Ten Mile Bayou Improvement Project can not be obtained by purchase or negotiation. Pursuant to your agreement with the City of West Memphis and the United States Engineers. we respectfully call upon you to acquire the necessary right of way by the e:_ercise of your power and right of erxinent domain. We lmow that statements are attributed by the press to one of your members that the legal authority of your district to acquire this right of way and to maintain the project is questionable. :here can be no question that this bayou is the principal outlet of your district, and that which is the outlet for all drainage of the City of West Memphis and its surrounding territory. We are advised that a drainage district has complete legal authority to acquire and maintain an adequate outlet as a part of its drainage system. We firmly believe that if you will consult your legal adviser. he will advise that you have complete legal authority in the pretrdses. We urge you to take the necessary action pursuant tc your agreement. and. pursuant to the powers and. dLties conferred upon you in this matter.
