AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE DISPOSAL
OF HAZARDOUS MATERIAL, AND FOR
OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Utility Commission has removed certain hazardous
material and is in need of making proper disposal of such material pursuant to the appropriate
state and federal regulations; and
WHEREAS, competitive bidding for the disposal of such material would not be
appropriate under these circumstances due to the strict state and federal regulations and the
potential liability associated therewith; and
WHEREAS, time is of the essence in order to properly dispose of such material, it would
not be feasible or practical to conduct competitive bidding for such services under such
circumstances;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following services to be used by the City,
described as follows:
The disposal by Rollins Environmental, Inc., of hazardous material in accordance with the
schedule of costs attached hereto as Exhibit "A".
