AN ORDINANCE TO REZONE A 40.6 ACRE TRACT OF LAND LYING IN THE
SW1/4 OF SECTION 6, T-6-N, R-9-E, AND BEING A FRACTIONAL PART
OF LOT 5 OF THE TAYLOR/HEMENWAY SUBDIVISION TO THE CITY OF
WEST MEMPHIS, CRITTENDEN COUNTY, ARKANSAS TO C-2 OPEN DISPLAY
COMMERCIAL DISTRICT, DECLARING AN EMERGENCY, AND FOR OTHER
PURPOSES.
WHEREAS application was made to the City Planning
Commission to change the Comprehensive Plan and rezone the
hereinafter described property, and after notice having been
published for the time and in the manner as provided by
Ordinance No. 715, as amended, the matter was heard by the
City Planing Commission, and the planning commission
recommended that the application be approved and the City
Council finds that such application should be granted;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION I: That the following described property located
in the City of West Memphis, Crittenden County, Arkansas, to
wit.
A 40.6 acre tract of land lying in the SW 1/4 of
Section 6, T-6-N, R-9-E, and being a fractional part
of Lot 5 of the Taylor/Hemenway Subdivision to the
City of West Memphis, as shown by plat recorded at
Plat Book 3, page 150 in the office of the Circuit
Clerk and Ex-officio recorder of Crittenden County,
Arkansas, and being more particularly described as
follows:
Commencing at the southeast corner of the SWl/4, of
Section 6, T-6-N, R-9-E, thence west along the south line
of said Section 6 a distance of 40.0 feet to its
intersection with the West right-of-way line of State
Highway 191, thence along said west right-of-way the

following bearings and distances, N00°37'02"E a distance
of 213.03 feet, thence N03°44'20"W a distance of 100.11
feet, thence NO1°00'46"W a distance of 200.00 feet,
thence N03°36'54"W a distance of 163.18 feet, thence
N07°27"05"W a distance of 14.89 feet to the point-of-
beginning, thence N89°10'00"W a distance of 1633.78 feet
to a point, thence N11°14'09"W a distance of 1463.15 feet
to its intersection with the south right-of-way line of
Interstate 40 and 55, thence along said south right-of-
way the following bearings and distances S71°13'50"E a
distance of 339.88 feet, thence S65°30'57" E a distance
of 1012.30 feet, thence S24°09'03"W a distance of 5.0
feet, thence S65°30'57"E a distance of 200.0 feet, thence
N24°09'03"E a distance of 5.0, thence S65°30'57"E a
distance of 458.99 feet to a point on the west right-of-
way line of State Highway 191, thence along said west
right-of-way S00°36"43"W a distance of 70.75 feet, thence
S07°27'05"E a distance of 531.88 feet to the point-of-
beginning containing 40.6 acres more or less with a
physical address of 1550 N. 7th Street.
Be, and the same is hereby rezoned as C-2, Open Display
Commercial District.
SECTION II: EMERGENCY CLAUSE: It is found and
determined by the City Council that this ordinance is
necessary for owner and buyer of the property to be able to
properly utilize such property for development which includes
an urgent need to begin construction during the present season
because of weather coriditioris, financial considerations and
other reasons; and this ordinance is necessary for the growth
and expansion of the city of West Memphis, and that the
passage of this ordinance is in the interest of the public
health, peace, safety and welfare of the city of West Memphis
and the inhabitants thereof. Therefore, an emergency is
hereby declared to exist and this ordinance shall take effect
and be in force immediately on its passage and approval.
SECTION III: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
