AN ORDINANCE TO REZONE A 228.24 ACRE TRACT OF LAND LYING IN
SECTION 6, T-6-N, R-9-E, IN THE CITY OF WEST MEMPHIS,
CRITTENDEN COUNTY, ARKANSAS TO C-2 OPEN DISPLAY COMMERCIAL
DISTRICT, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.
WHEREAS application was made to the City Planning
Commission to change the Comprehensive Plan and rezone the
hereinafter described property, and after notice have been
made for the time and in the manner as provided by Ordinance
No. 715, as amended, the matter was heard by the City Planing
Commission, and the planning commission recommended that the
application be approved with regard to the property lying
north of the Interstate and east of north 7th street and the
City Council finds that such application should be granted in
its original form and that the entire 228.24 acre tract of
land should be rezoned C-2, Open Display Commercial District;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION I: 'T'hat the following described property located
in the City of West Memphis, Crittenden County, Arkansas, to
wit.
A 228.24 acre tract of land lying in Section 6, T-6-
N, R-9-E, City of West Memphis, Crittenden County,
Arkansas being more particularly described as
follows:
Beginning at the northeast corner of the NE 1/4, SE
1/4 of Section 6, T-6-N, R-9-E, thence S89°40'30"W a
distance of 1321.30' to a point, thence S00°21'36"W
a distance of 1325.79' to a point, thence S89°57'21"
E a distance of 780.00' to a point, thence
S33°01'03"W a distance of 628.28' to its
intersection with the north right-of-way line of
Interstate 40 and 55 thence N65°30'57"W along said
north right-of-way line a distance of 1643.33' to a
point thence N00°37'02"E a distance of 200.25' to a
point, thence N65°43'43"W a distance of 170.0' to a
point on the east right-of-way line of State Highway
191, thence along said east right-of-way line

to the Point of Beginning, containing 228.24 acres
more or less with a physical address of 1800-2399 N.

Be, and the same is Hereby rezoned as C-2, Open Display
Commercial District.
SECTION II: EMERGENCY CLAUSE: It is found and
determined by the City Council that this ordinance is
necessary for owner and buyer of the property to be able to
properly utilize such property for development which includes
an urgent need to begin construction during the present season
because of weather conditions, financial considerations and

other reasons; and this ordinance is necessary for the growth
and expansion of the city of West Memphis, and that the
passage of this ordinance is in the interest of the public.
health, peace, safety and welfare of the city of West Memphis
and the inhabitants thereof. Therefore, an emergency is
hereby declared to exist and this ordinance shall take effect
and be in force immediately on its passage and approval.
SECTION III: That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
