AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
PURCHASE OF NETWORK CABLING, INSTALLATION AND
CONFIGURATION OF DEVICES FOR A NEW DATA
INFRASTRUCTURE INCLUDING HARDWARE AND SOFTWARE,
DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis is in need of acquiring network cabling,
installation and configuration of devices for a new data infrastructure to replace the existing
Unisys data processing system; and
WHEREAS, the West Memphis Utility Commission has considered and recommended
the proposal of Howard Technology Solutions; and
WHEREAS, the City Council determines that competitive bidding should be waived for
the reason that the proposal of Howard Technology Solutions provides for complete installation
and configuration of the necessary hardware and software, including terminal devices, a Virtual
Private Network and server, and competitive bidding under such circumstances would not be
feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for the purchase network cabling,
installation and configuration of devices for a new data infrastructure for a total cost of
$79,186.00 to replace the existing Unisys data processing system. These items to be purchased
from Howard Technology Solutions. The contract between Howard Technology Solutions and
the City of West Memphis is hereby approved and the Mayor and City Clerk are hereby
authorized to execute said contract and such other documents as maybe necessary to effectuate
this purchase.
SECTION 2. Ail Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that an urgent and immediate need exists
to replace the existing Unisys LX5200 data processing system and to provide more efficient data
processing and networking capabilities between municipal offices, an emergency is hereby
declared, and this ordinance being necessary for the preservation of the peace, health, safety and
welfare of the citizens of West Memphis, Arkansas, shall be in full force and effect from and
after the date of its passage and approval.
