AN ORDINANCE TO WAIVE COMPETITIVE BIDDING ON THE PURCHASE
OF A FUEL TRUCK FOR THE WEST MEMPHIS MUNICIPAL AIRPORT
COMMISSION, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Airport Commission is in the immediate process of
negotiating the termination of the present leases for the fixed base operator at the West Memphis
Municipal Airport with the intent of the Commission to assume the operation of the airport; and
WHEREAS, the West Memphis Airport Commission is in need of a fuel truck for the
operation of the airport and the proposed termination of the leases is to occur in less than thirty

days and competitive bidding under such circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Competitive bidding be waived for the following item or services to be
used by the City, described as follows:
One used fuel truck, not to exceed $20,000.00.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Mempl~.is, Arkansas, that an urgent and immediate need exists on
the part of the West Memphis Airport Commission to acquire a used fuel truck in order to
provide for the continued operation of the West Memphis Municipal Airport by the Commission
after the termination of the present leases for the fixed base operator which are proposed to be
terminated in less than thirty days, an emergency is hereby declared to exist, and this Ordinance
being necessary for the preservation of the public peace, health, safety and welfare of the citizens
of West Memphis, Arkansas, shall be in full force and effect from and after the date of its passage
and approval.
