AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR PAINTING
STREET LIGHT POLES, DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Utility Commission has twice sought competitive bids
for the painting of street light poles without receiving any timely bids; and

WHEREAS, one bid from CTS Construction, Inc., in the amount of $.L9-B~T13 was
received late and it was the only late bid; and
WHEREAS, it would not be feasible or practical to require additional competitive
bidding far such services and the bid from CTS Construction, Inc., is within the budgeted amount
for such services and the West Memphis Utility Commission desires to accept the bid from CTS
Construction, Inc., in order to proceed with this project without further delay;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Competitive bidding be waived for the following item or services to be
used by the City, described as follows:
Painting 140 - 30' steel street light poles with arms; 12 - 50' parking lot steel poles and I 1
traffic light poles with mask arms (approximately 30') to be provided by CTS
Construction, Inc., at the cost of $16,916.15 in accordance with the attached proposal.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that an urgent and immediate need exists to
provide needed maintenance for street light poles, parking lot light poles and traffic light poles
and that such work should commence as soon as possible so that it can be completed within thirty
(30j days as set out in the proposal without weather delays, the possibility of which will be
increased if the effective date of this ordinance is delayed. As a result, an emergency is hereby
declared to exist, and this ordinance being necessary for the preservation of the public peace,
health, safety and welfare of the citizens of West Memphis, Arkansas, shall be in full force and
effect from and after the date of its passage and approval.
