AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR
CONSTRUCTION OF A STORM DRAIN, BOX AND HEADWALL,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-_58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Utility Commission has sought proposals for the
construction of the storm drain, box and headwall with the only response being received from
Crittco Construction Co., in the amount of $37,500.00; and
WHEREAS, it would not be feasible or practical to require additional competitive
bidding for the construction when Crittco Construction Co., is the only contractor to submit a
proposal and the West Memphis Utility Commission desires to accept the bid from Crittco
Construction Co., in order to proceed with this project without further delay;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Competitive bidding be waived for the following item or services to be
used by the City, described as follows:
Construction of a storm drain, box and headwall at the cost of $37,500.00 in accordance
with the attached proposal.
SECTION 2. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that an urgent and immediate need exists to
begin this work due to the difficulty finding a contractor to do this type of work and the
contractor being available to do the work now and if the effective date of this ordinance is delayed
the contractor may not be available to do the work at a later date. As a result, an emergency is
hereby declared to exist, and this ordinance being necessary for the preservation of the public
peace, health, safety and welfare of the citizens of West Memphis, Arkansas, shall be in full force
and effect from and after the date of its passage and approval.
