AN ORDINANCE GRANTING A SPECIAL PERMITTED USE TO ALLOW A DAY CARE
FACII,ITY, FOR KATHLEEN CHARLES, AT 901 SOUTH 14TH STREET, ALSO KNOWN
AS; LOT IN SE 1/4 S18 - T6 - R9, SOUTH JEFFERSON AND SOUTH 14TH STREET,
WEST MEMPHIS, ARKANSAS.
WHEREAS, Application was made to the City Planning Commission of West Memphis,
Arkansas to allow a Special Permitted Use of the hereinafter described lands for the use of a Day
Care Facility ,per Zoning Ordinance No. 1258, as amended; and
WHEREAS, Notice of said hearing has been published for the time and in the manner as
provided by Ordinance No. 1258, the matter was heard by the City Planning Commission on
November 12, 1997, and upon the matter being heard by the City Planning Commission and due
consideration given thereof the City Planning Commission recommended that said application be
granted provided the following stipulations were agreed upon by the applicant, to wit:
1. Maximum number of children 35;
2. Meet all City and State Health Department requirements for day care facility;
3. Hours of operation to be from 6:00 A.M. until 12:00 A.M.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to wit: 901 South 14th Street, Lot
in SE 1/4, S18 - T6 - R9, South Jefferson and South 14th Street, West Memphis, Arkansas be
granted a Special Permitted Use allowing and permitting the use of the aforedescribed property
for the use of a Day Care Facility, allowed thereon in a R-2, Low Density Residential District.
SECTION II: That all Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
