AN ORDINANCE TO WAIVE COMPETITIVE BIDDING ON THE
CONSTRUCTION OF A FUEL FARM AT THE WEST MEMPHIS MUNICIPAL
AIRPORT, rr~T "" '"`T ~''~'`''~`~" 'AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section I4-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Airport Commission is in need of constructing a fuel
farm to serve the West Memphis Municipal Airport and the Commission has considered proposals
from several contractors and fuel suppliers and approved and recommended the proposal
submitted by The Southern Co. NLR, Inc., a copy of which is attached hereto; and
WHEREAS, the proposed fuel farm will be a vital part of the operation of the West
Memphis Municipal Airport and reliability and safety are major concerns and it would not be
feasible or practical to require competitive bidding and award such construction based upon the
lowest bid; and
WHEREAS, the future growth and development of the West Memphis Municipal Airport
depends greatly upon the installation of the fuel farm and the West Memphis Airport Commission
needs to proceed with this project without delay in order to proceed with additional projects and
to generate additional business and revenues for the airport;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Competitive bidding be waived for the following item or services to be
used by the City, described as follows:
The construction of a fuel farm at the West Memphis Municipal Airport by The Southern
Co., NLR, Inc_, as set out in the attached proposal, at a cost of $100,509.64.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
