1804ORDINANCE NO. O y AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR TURNOUTS FOR THE WEST MEMPHIS FIRE DEPARTMENT, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical; and WHEREAS, there are many items necessary for the City's use where competitive bidding is deemed not feasible or practical; and WHEREAS, the City of West Memphis and the West Memphis Fire Department are in need of purchasing new turnouts and Leeco, Inc., has quoted a competitive price that will remain fine until December 30, 1997, and competitive bidding under such circumstances would not be feasible or practical; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: 1. That competitive bidding be waived for the following item to be used by the City, described as follows: Purchase of sixty-four turnouts from Leeco, Inc., for the amount of $75,968.00. 2. Emergency Clause. It having been found and determined by the City Council of the City of West Memphis, Arkansas, that there is an urgent need by the City of West Memphis and the West Memphis Fire Department to purchase these turnouts by December 30, 1997, in order to save an eight percent price increase including freight and taxes, an emergency is hereby declared to exist, and this Ordinance being necessary for the preservation of the public peace, health, safety and welfare of the citizens of West Memphis, Arkansas, shall be in full force and effect from and after the date of its passage and approval. LEECO, INC. and `MORNING PRIDE MFG., are prepared to provide the West Memphis Fire Department with (64) sixty-four sets, of the new NFPA required BPR protection at a very competitive price of 51,187.00 each, these will be shipped freight and tax free, for a total purchase price of: 575,968.00. This price quote will remain firm until December 30, 1997. At which time, there will be a price increase of approximately S% . If purchased before this date, this could result in a substantial savings of $10,808.56 including freight and taxes. This price increase is standard among manufacturers, and would apply to any gear purchased from Morning Pride, or any other manufacturing company. LEECO, INC. personnel will come to the West Memphis Fire Department (at no additional charge) and do accurate measurements of your personnel, so you can be assured that the turn-outs will be designed to fit each indi~7dual firefighter for maximum protection. Delivery could be expected in 8 weeks after order is placed and measurements are taken. As a point of interest, as I stated these are very competitive prices, LEECO and Morning Pride has not been "under bid" on quality and price. You might wish to contact the El Dorado Fire Department to check thier formal bids on a similar set of gear to note that we were low bid.
