February 5, 1987-7- MINUTES WEST MEMPHIS CITY COUNCIL FEBRUARY 5, 1987 A regular meeting of the West Memphis City Council was held on Thursday, February 5, 1987 at 1:30 p.m. in the West Memphis City Council Chambers at City Hall, 205 S. Redding, West Memphis, Arkansas. Mayor Keith Ingram presided. Mayor Ingram called the meeting to order at 1:35 p.m. Prayer was offered by Reverend S. J. Parker. City Clerk Dan Craft called the roll. Those present were: Mayor Keith Ingram City Attorney David Peeples City Clerk Dan Craft Aldermen: Joe Brasfield Bill Burnett James Cooper Al Boals Gary Walker Pritchard Horton Roberta Jackson Jim Woodell Mike Hardage Roger Sumpter First item on the agenda was Bid Openings. Bids for the West Memphis Utility Department were opened by David Goacher and read by City Attorney Peeples. TWO - 1987 Mid-Size Half Ton Pick-Up Short Wheel Base Trucks Bidder Bid Hudson-Rook Olds. West Memphis, AR $15,400 Buchanan Chev. & Olds. Osceola, AR $15,150 Tom Gibson Ford ': West Memphis, AR $16,716 Alderman Walker made a motion, seconded by Alderman Hardage to accept the ;bids and refer them to the City Attorney and the Utility Commission to make a decision on the bid and award the contract. Upon voice vote of the council, the voting was unanimous. Next item on the agenda was a quarterly report from the City Treasurer, Aubrey Holt. Mr. Holt referred to the budget print-out and noted that there ,was an insert with the pension fund of the Police and Fire Department included. Alderman Burnett made a motion, seconded by Alderman Walker to approve the quarterly report from the City Treasurer for the last quarter of 1986. Upon voice vote, the !voting was unanimous. ' Next on the agenda was the last quarterly report of 1986 from City Clerk Dan Craft. Mr. Craft commended the Finance Department for a fine job done in 1986 and noted that the total budget appropriations were 98.9%. Alderman Burnett made a motion, seconded by Alderman Cooper to approve the City Clerk's !quarterly report. Upon voice vote, the voting was unanimous. CITIZENS REQUESTS None. Next item on the agenda was the approval or corrections "of the minutes of the January 15, 1987 City Council meeting. Alderman Hardage made a motion, seconded by Alderman Horton to disperse with the reading of the minutes-and approve as presented. Upon voice vote of the council, the voting was unanimous. -8- NEW BUSINESS First item under New Business was an Ordinance amending Ordinance No. 1162, dated March 1, 1984, authorizing all public schools in the City of West Memphis, Arkansas, a reduction on dumpster rates, declaring an emergency and for other purposes. City Attorney Peeples read the Ordinance. Alderman Walker made a motion, seconded by Alderman Jackson to adopt the Ordinance on its first reading. Upon roll call vote, the voting was as follows: AYES: Aldermen: Brasfield, Burnett, Cooper, Boals, Walker, Horton Jackson, Woodell, Hardage, Sumpter NAYS: Aldermen: None The motion carried. Alderman Burnett made a motion, seconded by Alderman Hardage to suspend the rules and the Ordinance be placed on its second reading. Upon roll call vote, the voting was as follows: AYES: Aldermen: Brasfield, Burnett, Cooper, Boals, Walker, Horton Jackson, Woodell, Hardage, Sumpter NAYS: Aldermen: None The motion carried. City Attorney Peeples read the Ordinance for the second time. Alderman Burnett made a motion, seconded by Alderman Horton, to further suspend the rules and the Ordinance be placed on its third and final reading. Upon roll call vote, the voting was as follows: AYES: Aldermen: Brasfield, Burnett, Cooper, Boals, Walker, Horton Jackson, Wooden , hardage, Sumpter NAYS: Aldermen: None The motion carried. City Attorney Feeples read the Ordinance for the third and final time. Discussion. Mayor Ingram asked "Shall the Ordinance Pass?°' Alderman Horton made a motion, seconded by Alderman Jackson to adopt the Ordinance. Upon roll call vote, the voting was as follows: AYES: Aldermen: Brasfield, Burnett, Cooper, Boals, Walker, Horton Jackson, Woodell, Hardage, Sumpter NAYS: Aldermen: None The motion carried. Alderman Hardage made a motion, seconded by Alderman Burnett to adopt the emergency clause section three. Upon roll call vote, the voting was as follows: AYES: Aldermen: Brasfield, Burnett, Cooper, Boals, Walker, Horton Jackson, Woodell, Hardage, Sumpter NAYS: Aldermen: None The motion carried. The Ordinance was assigned No. 1276. (Reduction on school dumpster rates) PERMISSION REQUESTS First item under permission requests was permission to destroy records in the Community Development Agency. Alderman Cooper made a motion, seconded by Alderman Burnett to approve the request to destroy the rocords as listed. Upon voice vote, the voting was unanimous. (Copy of records attached) Second request was permission to destroy records in the Finance Department. Alderman Cooper made a motion, seconded by Alderman Horton to approve the request to destroy the records as listed. Upon voice vote, the voting was unanimous. (Copy of records attached) Third request was permission to destroy records in the Police Department. Alderman Burnett made a motion, seconded by Alderman Walker to approve the request to destroy the records as listed. Upon voice vote, the voting was unanimous. (Copy of records attached) -9- Alderman Burnett made a motion, seconded by Alderman Walker to appoint Alderman Brasfield to witness the destruction of the records. Upon voice vote, the voting was unanimous. Next under Permission Requests was the recommendation of the Planning Commission. (A) To deny special permitted use for Dr. G.W. Sorrells located at 220 E. Broadway for apartments in a C-1 district. Discussion. Alderman Walker made a motion, seconded by Alderman Burnett to accept the recommendation of the Planning Commission and deny this request. Upon voice vote, the voting was unanimous. (B) The approval of the Preliminary and final plat on the Richland Subdivision 4th Addition Phase II. Alderman Burnett made a motion, seconded by Alderman Cooper to approve the plat. Discussion. Alderman Boals asked Mr. George '.questions pertaining to the stipulations included in the new Zoning Ordinance that was passed before the Mayor can sign the final plat. Mr. George stated ;that the Planning Commission recommended approval of the final plat based on the the necaly-established procedures, the Planning Commission will retain the ;original tracing and neither the Planning Commission nor the approval by the Mayor in acceptance of the dedications can occur until either: (a) the improvements have been completed, (b) a cash deposit is made with the City for completion of all improvements, or (c) a contract has been entered into for installation of the (improvements ~~ahich is accompanied by a performance bond as specified in the :Subdivision Regulations. Nir. George stated one of these provisions had been worked out with all parties concerned. Mayor Ingram stated these provisions were ':actually to discourage "fly-by-night" contractors from coming into the city and 'doing work and leaving in a state of disrepair ti~aith the city having to bear the costs. Alderman Burnett made a motion, seconded by Alderman Cooper to approve the recommendation from the Planning Commission and approve the preliminary and final plat. Upon voice vote, the voting was unanimous. Ne~~t, Mayor Ingram asl~ed Captain David Jones to come forward. Captain Jones stated that on January 12, 1987 there was an accident where a van overturned in a bayou ditch trapping three victims. Mr. Carl Jordan rescued a two-year-old child from the van. Mayor Ingram presented a certificate of appreciation to Mr. Jordan. COMMITTEE REPORTS Alderman Horton reported that the Budget Committee had met and requested the following budget changes: STREET DEPARTMENT Account Account No. Increase/Decrease Amount Small Equipment 211-906-00 x $2,800.00 Automotive Equipment 211-904-00 1~ $1,700.00 ,Heavy Equipment 211-005-00 x $4,500.00 Alderman Jackson made a motion, seconded by Alderman Walker to approve the !budget changes in the Street Department. Upon voice vote, the voting was unanimous. Alderman Hardage announced the Fire Committee would meet Wednesday, February 11, 1987 at 5:30 p.m. at City Hall. Alderman Walker reported the Sanitation Committee had met and discussed the dumpster rates that BFI should be charged and referred the matter to the City Attorney. City Attorney Peeples stated his office wrote a letter to BFI and to date, has had no reply. Alderman Walker stated the meter readers tiJere to turn -10- in a final count of dumpsters to the Sanitation Committee. Alderman Burnett reported the Public Works Committee met in pre-council and voted to recommend the fees for grass cutting on lots be set up in accordance with the fees in the State statutes. Alderman Burnett stated the bids for the city wide street clean up should be ready at the nett council meeting. APPOINTMENTS Mayor Ingram announced that the Advertising and Promotion Commission was to consist of (4) members from participating business, (1) member who serves as Mayor,&(2) members from the City Council. Mayor Ingram asl~ed for nominations. Alderman Walker nominated Alderman Jackson and Alderman Woodell to serve. Upon vice vote, the voting was unanimous. ANNOUNCEMENTS Mayor Ingram announced that he had appointed Robert Bateman as Sanitation Superintendent. Alderman Burnett made a motion, seconded by Alderman Walker to adjourn.
