Judge Brian Williams and Quorum Court Justice Dorothy Ward and Justice Bill Weaver were present. The Prosecuting Attorney and the Deputy Prosecuting Attorney did not attend. Judge Williams and Justice Ward and Weaver came forward to answer any questions from the Mayor or City Council. Alderman Horton asked according to his records, what was the status of his supply of money toward the drug fund. Judge Williams stated that according to the General Fund Report, as of August 31, 1988, there was $14,206.14. Judge Williams stated after these figures came out in the newspaper, Mr. Hale, Deputy Prosecuting Attorney; came to see him and it was determined that approximately $11,000 of those funds were carry over funds as of 1-1-88. The appropriation procedure that the court established for 1987 & 1988 was $100,000. The appropriation request was submitted by the Deputy Prosecuting Attorney to the Quorum Court with the understanding the first $100,000 that came in would be drawn out for drug enforcement purposes. Judge Williams went on to say that during 1987, $116,000 was put into the fund with one appropriated amendment of $5,000 made in December which made a total of $105,000 drawn out leaving a balance of around $11,000. Judge Williams stated to the best of his knowledge, there was $11,000 in the fund available for appropriation expenditure. Alderman Horton asked if the Deputy Prosecuting Attorney has complete control of this money. Judge Williams stated these monies are subject to the appropriation process and the Prosecuting Attorney has been the individual who has made the appropriation requests. These appropriations are available for any law enforcement agency who wants to make a request. -90- MINUTES - SEPTEMBER 15, 1988 Mayor Ingram asked if the money in this drug fund was .us®d f.or ah~ other item other than to pay informants and if the Quorum Court knows of any purchases. Judge Williams stated the Quorum Court has not been aware of any purchases but the money is appropriated by the Quorum Court and is subject to the County purchasing law which is any purchase over $5,000 has to be bid. Alderman Hardage asked if re-upholstering furniture could be purchased with that money. Alderman Hardage stated he knew this had been done. Judge Williams stated any purchase of materials or supplies, and services under $5,000 could be purchased. Discussion held concerning ~ the letter received from the Deputy Prosecuting Attorney and the requests made by the West Memphis Police Department for fund's . Alderman Boals stated Mr. Hale's letter stated the money requested would be available after the State Audit was completed and if an emergency situation occurred to contact him. Chief Sanders stated he had to transfer $500.00 into the drug fund because there was only $35.00 in that account. He stated the WMPD made another request for money but did not know if the letter requesting funds mentioned it was an emergency. Mayor Ingram stated in one of the letters from Mr. Hale stated we could not receive funds due to the audit and one letter stated there was not any money in the fund. Judge Williams stated the money Mr. Hale was talking about was the money in his account that is drawn from the drug fund and the account that~he draws from is the one that has $11,000 in it. Alderman Boals asked about the match-money mentioned in Mr. Hale's letter. Judge Williams stated that $4,770.47 was being held in Mr. Hale's bank account for match-money. Judge Williams stated the request for funds ~~9 mentioned in Mr. Hale's letter was a grant from the state in 1987 for the purchase of equipment and he believed this equipment was computer terminals. He stated he believed one of the terminal was placed at the Sherrif's Department. Mayor Ingram asked if one of the terminals was supposed to be placed in the West Memphis Police Department. Judge Williams stated he was not sure. Alderman Hardage stated he felt this all was a case of "lack of communication." He stated this was a problem we needed to face for the good of our community against these drugs. Alderman Hardage made a motion, seconded by Alderman Cooper for Chief Sanders and the West Memphis Police Department to write the Quorum Court when they have a request for drug money. Discussion. Alderman Hardage suggested a committe be formed consisting of one council- person from each municipality, a quorum court member & two citizens at large from the county. Justice Ward stated such a large commission would compromise the secrecy that they need in drug prosecution. Justice Weaver stated as the members of the drug fund committee, it was their responsibility to look into the operation and assure the people that it was being run properly and monies were properly accounted for. He stated he thought they might need to reexamine their procedure. He also stated he could understand the problem the City of West Memphis is having and that they would talk to the Deputy Prosecuting Attorney about disbursing those funds and see if they could speed up the process. MINUTES - SEPTEMBER 15, 1988 -91- Alderman Lehr asked about the process of the money that is taken in by the City of West Memphis. Judge Williams t~.ted the fines for felony cases are assessed by the Circuit Court, collected by the Sheriff, and deposited in the county treasury and appropriated by the Quorum Court. Any records on the amount of money fined could be obtained from the Circuit Clerk. Next a voice vote was held on the motion to make a written request to the Quorum Court for any drug monies. Upon voice vote, the voting was unanimous. Mayor Ingram asked if it was under the jurisdiction of the Quorum Court when funds are used as match funds and etas that with the approval of the Quorum Court or is that money put up at the discretion of the Prosecuting Attorney. Judge Williams stated the grants that the county acquire has to be approved to apply for those grants and the expenditure of those including the match money that you have to put u~ has to be appropriated by the court. Mayor Ingram asked if the money requested by the Prosecuting Attorney's Office for a Drug Law Enforcement Program Apprehension Grant this year was brought before the Quorum Court. Judge Williams and Justices Ward and Weaver stated they were not specifically aware of this. Mayor Ingram stated that it was his understanding that the Prosecuting Attorney's Office planned for the grant money, the money that the City of West Memphis was not allowed to get totally as a city, the total amount of the grant was split with the Prosecuting Attorney's Office and that Prosecuting Attorney told the grant people that the money was going to be used to hire another Deputy Prosecuting Attorney in this county. Mayor Ingram asked if Judge Williams, Justice Ward and Justice Weaver were aware of that information. They all answered they were not aware of that. Chief Sanders stated they when went to Little Rock to go before the Grant Board, they asked if they had been before the City Council and the Quorum Court for permission to apply for the grant and appropriate the matching funds. Chief Sanders reminded the council that he had gone through the procedure with the City Council. Justice Weaver, Ward and Judge Williams did not remember the Prosecuting Attorney going before them for permission and using this money to hire another Deputy Prosecuting Attorney. Mayor Ingram stated we understood the need for confidentialality because the city appropriates money to the Police Department to use as they see fit and if they need special equipment they request the money be put in their budget. Mayor Ingram stated he understood the drug fund money is turned over to the Prosecuting Attorney and he buys equipment as he sees fit. Judge Williams stated any budget he or any other county official is responsible for are gone by the purchasing law. Mayor Ingram thanked Judge Williams and Justices Ward and Weaver for talcing the time to appear before the council. Alderman Burnett stated he would like to know how much of the $100,000 is used by police departments and how much is used for hardware, and administrative costs. Mayor Ingram stated those records are kept in the Prosecuting Attorney's Office. Alderman Burnett asked the procedures for confiscated vehicles in drug arrests. Chief Sanders stated when the case goes through circuit court, the circuit judge orders that vehicle turned over to the city, county & state. He stated this -92- MINUTES - SEPTEMBER 15, 1988 was a new law and before this law was passed, the vehicles were turned over to the city.
