MINUTES WEST MEMPHIS CITY COUNCIL AUGUST 3, 2000 A regular meeting of the West Memphis City Council was held on Thursday, August 3, 2000 at 1:30 p.m. in the City Council Chambers at City Hall, 205 S. Redding, West Memphis, Arkansas. Mayor William H. Johnson presided. Mayor Johnson called the meeting to order at 1:33 p.m. City Clerk Phillip Para called the roll. Those present were: Mayor William H. Johnson, City Attorney David Peeples, City Treasurer Frank Martin, Councilors: Thomas Burroughs (late), Roberta Jackson, Brian Reece, Harold Thomas, James Pulliaum, Lorraine Robinson, Tracy Catt, Dr. C. W. Peeples, and Al Felton. Absent: Councilor Gheric Bruce. Mayor Johnson declared a quorum present. Brother Bruce McCarty of 1St Assembly of God Church offered prayer. CITIZENS REQUESTS Sharon Masner, 1123 Masner Road -Her property located west of Airport Road, north of Highway 70 and south of the inter-modal rail yard was annexed into West Memphis four years ago and she still does not have city water. She stated ordinance #1760 requires the city to provide city services within three years of an annexation. However the provision requiring municipal water services was marked through. City Attorney Peeples explained the General Manager of West Memphis Utilities recommended that be stricken from the ordinance prior to the ordinance being submitted to the council. He also stated that this property currently is still under litigation challenging the validity of that annexation. Ms. Masner said that there is a sixty-acre lot that divides her property and the Highway Department rest area and it has West Memphis City water. Mayor Johnson stated this matter needs to be referred to the Utility Commission because they are the ones who make those decisions and they are the ones who approved the highway department tying into the city water lines at their own expense. He also explained the utility commission's policy on annexed areas regarding water is the developer pays for the cost of a 6" waterline throughout the property and the city pays the difference between a 6" and a 12" line. Pulliaum recommended Mayor Johnson contact the highway department to see if they would allow Ms. Masner to tie into their water line. Charles Hughes, 303 N. 36th Street -stated he has a huge concern regarding the motel that is planning to build on the property joining the rear of his property. He expressed concern of his property value going down and his privacy. The motel design calls for a two-story structure with doors and windows on both sides, which he is feels the second floor will be able to see into their house even with a 10' fence. Mayor Johnson stated the city council in pre-council agreed among themselves unanimously that this matter be referred back to the Design Review Commission and ask that they review this again before any permits will be issued. Neal Hutchinson, 3601 Beatty -present to express concerns about the motel being built in their neighborhood. He presented pictures of the lot where the motel is to be built and some of the houses that will be effected by this. He expressed concerns that if a motel is brought in they will have problems with prostitution and drugs. Mayor stated he would see that Mr. Hutchinson will be notified of the DRC meeting and that he would be allowed to speak. Teresa Curtis, 305 N. 36th Street -expressed concerns with her privacy and what her four children will be exposed to if the motel is allowed to build as planned. Jafus Rogers -Executive Director of Council of Friendship, Inc. brought a group of workers and volunteers from his summer day camp program. He thanked the mayor and council for making this program possible. MINUTES 2 Mayor Johnson pointed out a mistake in the bid openings of Community Development.
