(See attached) Mayor Johnson read and presented a Proclamation proclaiming Tuesday, August 6th, 2002 as "National Nite Out" in West Memphis, Arkansas. Officer Christopher of the West Memphis Police Department accepted the proclamation. CITIZENS REQUESTS Wendell King, representing West Memphis Fire Fighters Association - present to try to come up with an agreement or compromise on the sick leave policy for the firefighters. He stated the firemen have been promised these sick leave hours when they retire and are now threatened to losing the money they have been promised all these years by changing it to 60 / 8 hr. days. He said that if you dock them 3 -(8) hour days when they call in sick for a shift, but only allow accumulating one (8) hour day was unfair labor practice. He asked the council to keep an open mind because they are affecting a lot of peoples lives. Mayor Johnson stated there would be a work session held next Wednesday at noon with the full council, city attorney and personnel department to try to resolve this matter. Thomas Malone, District Field Representative for the International Fire Fighters Association stated this is not the first time that this dilemma has come up before a city council in the state of Arkansas. He said he understands the threat that West Memphis is possibly coming under with state auditors, but did not see anywhere else in Arkansas where there was any action taken that a body of city council members that gives their employees some type of benefit that has been promised to them since the inception of their employment. He compared this to the City of Fayetteville, Benton, and Little Rock. He said this does not affect police officers because they are 8 hour employees. He stated he believed the intention of the law was the deduction of sick time that came out of Pine Bluff case law and then ultimately became a supreme court decision The deduction of 8 hours for the 24 hours in Pine Bluff was what was at fault but did not see anything in the supreme court ruling that denies the fact that a local municipality has the right to supersede that law and give more benefits than the minimum threshold. He said by law, the city could pass an ordinance extending the 60 day accumulation of sick leave to 90 days. Councilor Pulliaum moved, seconded by Felton to allow Susan Mullens to speak. Upon voice vote, the voting was unanimous. Susan Mullens, of Ingram Court Senior Apartments - 398 Ingram Blvd. -requested the city's help with control of the birds in their area. She said over 500 or more birds roost near the apartments and create a huge nuisance. She said that Mike from bird control in Stuttgart said he would teach her how to shoot but there was a cost of $35.00 for a box of 100 bullets and it would take 700. Mayor Johnson said the city could possibly fund the $250.00 and that he would contact her and the people in Stuttgart and see what it is they are using that might alleviate their problem. MINUTES Councilor Pulliaum moved, seconded by Councilor Catt to dispense with the reading of the minutes of July 18, 2002 and approve as submitted. Upon voice vote, the voting was unanimous. The motion carried. OLD BUSINESS 2nd reading of an ordinance to amend the Personnel Manual of the City of West Memphis, Arkansas and for ofher purposes. Alderman Felton stated there were two resume's for appointments to the Utility Commission included in the packet for the next council agenda and said that as of August 1st there are three position's available on the Utility Commission. Alderman Bass asked if the mayor had received any information on the investigation of the firefighter that was on a fire scene after he resigned. Mayor Johnson said the incident had been investigated and the firefighter was on the scene but was still on the payroll and will be until he has used the remainder of his vacation time. The reason he was on the scene is because he formerly had worked in that building and had some information on the building that he passed on to the Fire Department.
