AN ORDI"+IANCE WAIVING COMPETITIVE BIDDING FOR THE
PURCHASE CQ!VIPUTER EQUIPMENT AND MAINTENANCE FOR THE
WEST MI':iMI'HIS DISTRICT COURT AND FOR OTHER PURPOSES.
WHEREAS, <arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible or
practical; and
WHERE ~S, the West Memphis District Court is in need of acquiring additional
computer equipment, including hardware and software as set out in the attached Exhibit "A", and
to provide for a n~:.~ntenance agreement to provide service for such equipment; and
WHERE.~S, the West Memphis District Court currently has its computer equipment
covered under a maintenance agreement with Coastline Micro and it would not be feasible or
practical to have rdditional computer equipment covered by a maintenance agreement with
another entity; anc
WHERE.~.S, the City Council determines that competitive bidding should be waived for
the reason that thr: purchase of this equipment from Coastline Micro and its coverage under the
current maintenar,..e agreement will permit the Court's computer system to be maintained by one
provider and, if purchased elsewhere, the equipment would have to be covered by a separate
maintenance agreement and having the Court computer system covered under maintenance
agreements throurh multiple entities would lead to confusion grid delay in getting the necessary
maintenance for t~:L: C u~~rt's computer equipment and would hinder the operations of the Court
and competitive bi:iding under such circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST :MEMPHIS, ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for the purchase and installation of
the computer equipment, including hardware and software as set out in Exhibit "A", all of which
is to be covered under the current maintenance agreement, for a total cost of $12,183.00. These
items to be purchased from Coastline Micro.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
