AN ORDINANCE TO AMEND THE WEST MEMPHIS LAND
SUBDIVISION AND DEVELOPMENT CODE IN REGARDS TO FIRE
HYDRANTS.
WHEREAS, upon due notice and publication, a public hearing was held before
the Planning Commission on April 28, 2010 and the Planning Commission recommended
for adoption a certain proposed amendment to the Land Subdivision and Development
Code of the City of West Memphis, Arkansas, adopted by Ordinance 1266; and
WHEREAS, the City Council finds the proposed amendment to the Land
Subdivision and Development Code of the City of West Memphis should be adopted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Article 1V; Section 1; Paragraph D of the Land Subdivision and
Development Code of the City of West Memphis, Arkansas, as adopted by Ordinance
1266 is hereby amended to add the following text, as paragraph D, number 1:
1. FIRE HYDRANTS -When public water is provided, fire hydrants shall be
installed by the subdivider. The number and location of fire hydrants shall be determined
by the West Memphis Utility Commission, or subject to review and approval of the West
Memphis Fire Department. All lots shall be within (1000) feet of a fire hydrant when
public water is available.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
