AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS
OF FLOODED ULTRA VIOLET UNITS AT THE SEWER TREATMENT
PLANT, DECLARING AN EMERGENCY, AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis and the West Memphis Utility Commission
were in immediate need to repair six flooded ultra violet units at the sewer treatment plant in
order to keep the facility operating and to remain within NPDES permit requirements; and
WHEREAS, the needed repairs were made by Infilco Degremont at a cost of $56,637.30;
and
WHEREAS, the West Memphis Utility Commission has recommended approval of the
payment of $56,637.30 to Infilco Degremont finding that there was an immediate need for the
ultra violet units to be repaired; and
WHEREAS, the City Council finds that competitive bidding should be waived for the
reason that there was an immediate need for the repairs to be made in order to keep the treatment
plant operating and to remain in compliance and competitive bidding under such circumstances
would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for repairs to six flooded ultra violet
units at the sewer treatment plant provided by Infilco Degremont at a cost of $56,637.30.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that an urgent and immediate need existed
to repair six flooded ultra violet units at the sewer treatment plant in order to continue to operate
and to remain in compliance, an emergency is hereby declared, and this ordinance being
necessary for the preservation of the peace, health, safety and welfare of the citizens of West
Memphis, Arkansas, shall be in full force and effect from and after the date of its passage and
approval.
