AN ORDINANCE TO AMEND SECTION 2.82.020 OF THE WEST
MEMPHIS MUNICIPAL CODE REGARDING THE RESIDENCY
REQUIREMENT FOR CITY EMPLOYEES AND FOR OTHER
PURPOSES.
WHEREAS, Section 2.82.020 of the West Memphis Municipal Code established the
policy of the City of West Memphis regarding residency of city employees; and
WHEREAS, Section 2.82.020 of the West Memphis Municipal Code should be amended
to address the consequences of failure to establish residency as required;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Section 2.82.020 of the West Memphis Municipal Code is hereby
amended to read as follows:
It is the policy of the city that, unless waived by a majority vote of the City
Council, all city employees shall live within the boundaries of Crittenden County,
Arkansas; that all new employees must move within the boundaries of Crittenden
County, Arkansas, within ninety days after employment; any new employee who
fails to establish residency within Crittenden County within ninety days of the
date of employment shall be automatically terminated; that city employees who
move beyond the boundaries of Crittenden County, Arkansas, shall be
automatically terminated; providing, however, this section shall not apply to any
city employee now employed by the city before the effective date of this
amendment who now live outside Crittenden County. The City Council, by a
majority vote of its members, may waive the residency requirement where there is
a need for an employee or Department Head with special skill or qualifications.
SECTION 2. Section 2.4 of the Personnel Manual for the City of West Memphis is
hereby amended to read as set out in the amended Section 2.82.020 of the West Memphis
Municipal Code.
SECTION 3. All ordinances or parts of ordinances or resolutions or parts of resolutions
in conflict herewith are hereby repealed to the extent of such conflict.
