AN ORDINANCE TO AMEND ORDINANCE 1258 REGARDING ZONING
REGULATIONS FOR THE CITY OF WEST MEMPHIS, ARKANSAS,

WHEREAS, the Planning Commission of the City of West
Memphis, Arkansas, has prepared amendments to Ordinance 1258,
which adopted zoning regulations and an official zoning map for
the City of West Memphis, Arkansas; and
WHEREAS, not fewer than three (3) copies of said amendments
to Ordinance 1258 have been on file in the office of the City
Clerk in the West Memphis Cit,v Hall and will continue to be on
file at all times for public inspection and review; and
WHEREAS, after a public hearing upon due notice and
publication, pursuant to Article I:k, Sections 5, 6 and 7 of the
zoning regulations adopted by Ordinance 1258, the Planning
Commission has approved and recommended for adoption the
proposed amendments to the zoning regulations adopted by
Ordinance 1258;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Article III, Section 2, (A)(2) of the zoning
regulations adopted by Ordinance 1258 is hereby amended to add
the following information:
Certain retail establishments with outside display shall be
allowed by Special Permit as an accessory use to the primary
business.
SECTION 2. Article III, Section 2, (B)(1) of the zoning
regulations adopted by Ordinance 1258 is hereby amended with
respect to Commercial Use s_ to add the following requirement:
1. COMMERCIAL USES
Retail Establishments not O-1 C-1 C-2
listed with outside sales
or display. SP X
SECTION 3. Article III, Section. 2, fD}(3) of the zoning
regulations adopted by Ordinance 1258 is hereby amended to add
the following information:
In addition, any Special Permit Accessory Use with outdoor
display of merchandise will be allowed as long as said
display of merchandise is stored inside the. building after
normal working hours. No required parking can. be used for
outside display and. access ways can not be blocked.
SECTION 4. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION 5. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is a.n urgent need by the City of West
Memphis and the West Memphis Planning Commission to amend
Ordinance 1258 regarding the zoning regulations to accommodate
the Main Street Program and that time is of the essence, an

emergency is hereby declared to exist, and this Ordinance being
necessary for the preservation of the public peace, health,
safety and welfare of the citizens of West Memphis, Arkansas,
shall be in full force and effect from and after the date of its
passage and approval.
