AN ORDINANCE VACATING A PORTION OF THE ALLEY RUNNING
THROUGH BLOCK 3 OF WHEELER SUBDIVISION AND A PORTION
OF THOMAS AVENUE, IN WEST MEMPHIS, ARKANSAS.
WHEREAS, a petition was duly filed with the City Council
of the City of West Memphis, Arkansas, on the 24th day of
March, 1993, asking the City council to vacate a portion of
the alley running through Block 3 of the Wheeler Subdivision
and a portion of Thomas Avenue in the City of West Memphis,
Arkansas, as hereinafter more particularly described; and
WHEREAS, after due notices as required by law, the City
Council has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has
ascertained that the portions of the alley and street
hereinafter described have heretofore been dedicated to the
public's use; have not been actually used by the public
generally for a period for at least five years subsequent to
the filing of the plat whereby they were dedicated; that
petitioners are the sole owners of the property abutting upon
~r' the portions of the alley and street to be vacated; and that
public interest and welfare will not be adversely affected by
the abandonment of such portions of said alley and street.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
Section 1. The City of West Memphis hereby releases,
vacates and abandons all its rights, together with the rights
of the public generally subject only to existing utility

easements, in and to the portions of the alley and street
described as follows:
(a) The 30-foot alley abutted on the north by
Lot 1, and on the south by Lot 14 in Block 3 of
Wheeler Subdivision, West Memphis, Arkansas, as
shown by plat of record in Plat Book 2 at pages 113
and 114, more particularly described as beginning at
the northwesterly corner of said Lot 14, thence
continue in a northerly direction 30 feet to the
southwesterly corner of said Lot 1, thence easterly
along the south line of said Lot 1 to the
southeasterly corner of Lot 1, thence south 30 feet
to the northeasterly corner of said Lot 14, thence
westerly to the point of beginning;
(b) That part of Thomas Avenue abutted on the
south by Lot 1 in Block 3 of the Wheeler Subdivision
as shown by the above plat and on the north by the
acreage as shown on the above plat and more
particularly described as beginning at the

the City Clerk shall be filed in the office of the Recorder of
Crittenden County, Arkansas, and recorded in the deed records
of the County.

and Thomas, Inc., petitioning the said City Council to vacate
the following alley and street:

of beginning.
All persons are hereby notified and advised
that the City Council of the City of West Memphis,
Arkansas, will hear said petition and determine
whether the alley and street hereinabove
specifically described shall be vacated at a meeting
of said City Council to be held on the 6th day of
May, 1993, at 1:30 p.m.
