AN ORDINANCE GRANTING A SPECIAL PERMITTED USE OF A 5.57
ACRE TRACT OF LAND LYING IN THE E1/2 OF SECTION 14, AND
THE NW1/4, NW1/4 OF SECTION 13, T-6-N, R-8-E, CITY OF
WEST MEMPHIS, CRITTENDEN COUNTY, ARKANSAS, DECLARING AN
EMERGENCY, AND FOR OTHER PURPOSES.
WHEREAS, application was made to the City Planning
Commission for a special permitted use of the hereinafter
described property to construct a building for use as an
Institution for the Aged and Health Center, and after notice
having been published for the time and in the manner as
provided by Ordinance No. 1258, the matter was heard by the
City Planning Commission, and the Planning Commission
recommended that the application be approved and the City
Council finds that such application should be granted; NOW,.
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
MEMPHIS, ARKANSAS:
SECTION I: That the following described property located
in the city of West Memphis, Crittenden County, Arkansas, to
wit:
A 5.57 acre tract of land lying in the E1/2 of Section
14, and the NW1/4, NW1/4 of Section 13, T-6-N, R-8-E,
City of West Memphis, Crittenden County, Arkansas, being
more particularly described as follows:
Commencing at the Northeast corner of said Section 14,
thence N87°37'E along the centerline of U.S. Highway No.
70 a distance of 44.30 feet call distance 40.0 feet,
thence SO°27'00"E a distance of 60.03 feet to its
intersection with the South right-of-way line of U.S.
Highway No. 70 also the point-of-beginning, thence
587°37'00"W along said South right-of-way line a distance
of 77.38 feet, thence SO°00'54"E along said right-of-way
line a distance of 24.91 feet, thence N71°13'49"W along
said right-of-way line a distance of 2.57 feet to the
N.E. corner of the Lutheran Church property, thence
SO°27'00"E along the East line of the Lutheran Church
property a distance of 503.02 feet to the S.E. corner of
the Lutheran Church property, thence S87°37'00"W along
the South line of the Lutheran Church property a distance
of 350.13 feet to a point, thence S09°33'48"W a distance
of 514.71 feet to a point, thence S80°26'12"E a distance
of 357.03 feet to a point on the West line of Meadowbrook
Village Subdivision to the City of West Memphis, thence
along a curve that breaks to the left with a radius of
585.85 feet an arc length of 145.49 feet to a point,
thence N09°33'48"E a distance of 640.70 feet to a point,
thence along a curve that breaks to the left with a
radius of 896.11 feet an arc length of 156.61 feet to a
point, thence NO°27'00"W a distance of 185.02 feet to the
point-of-beginning, containing 5.57 acres more or less.
This property is subject to easements as shown in the
attached plat.

SECTION II: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION III: EMERGENCY CLAUSE: It is found and

determined by the City Council that this ordinance is
necessary for owner of the property to be able to properly
utilize such property for development for an Institution for
the Aged and Health Center which includes an urgent need to
begin construction during the present season because of
weather conditions and other reasons; and this ordinance is
necessary for the growth and expansion of the city of West
Memphis, and that the passage of this ordinance is in the
interest of the public health, peace, safety and welfare of
the city of West Memphis and the inhabitants thereof.
Therefore, an emergency is hereby declared to exist and this
ordinance shall take effect and be in force immediately on•its
passage and approval.
