AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
PROPERTY LOCATED AT 2301 EAST BROADWAY, ALLOWING AN
AUCTION IN A C-2, COMMERCIAL DISTRICT.
WHEREAS, application has been made to the City Planning Commission, on
May 26, 2010, for a Special Use Permit to allow an Auction in a C-2, Commercial
District, as required by Ordinance No. 1988, as amended.
WHEREAS, after notice had been published for the time and in the manner as
provided by Ordinance No. 1988, as amended, the matter was heard by the City Planning
Commission on Wednesday, May 26, 2010 and the Planning Commission recommended
a Special Use Permit be granted to allow an Auction at 2301 E. Broadway, located in a
C-2, Commercial District, with the following criteria:
1. No outside storage;
2. No parking on S. 23 Street;
3. Hours of operation 6:00 am - 10:00 pm, Monday thru Saturday;
4. Strip parking lot to meet minimum parking and handicap parking code
requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS ARKANSAS:
SECTION 1: The following described property, to wit:
Address: 2301 E. Broadway
West Memphis, Arkansas
Legal Description: Block 183
George T Kendal Subdivision
and the same hereby is granted a Special Use Permit allowing an Auction at 2301 E.
Broadway, located in a C-2, Commercial District, with the following criteria:
1. No outside storage;
2. No parking on S. 23 Street;
3. Hours of operation 6:00 am - 10:00 pm, Monday thru Saturday;
4. Strip parking lot to meet minimum parking and handicap parking code
requirements.

SECTION 11: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
