AN ORDINANCE GRANTING A SPECIAL PERMIT USE OF EAST 20' FEET
OF LOT 2 AND LOTS 3, 4, 5, AND 6 AMENDED PLAT OF M. L.
THOMPSON, 3RD ADDITION, 512 E. BROADWAY ON THE EMERGENCY
AND FOR OTHER PURPOSES
WHEREAS, application has been made to the City Planning Commission to allow a
Special Permitted Use of an Accessory Display in a C-1 Commercial District, as required
by Ordinance 1258, as amended.
WHEREAS, After Notice had been published for the time and in the manner as
provided by Ordinance 1258, as amended, the matter was heard by the City Planning
Commission and the Planning Commission recommended that a Special Permit Use be
granted to said property to permit an Accessory Display in a C-1 Commercial District
subject to the special conditions as follows:
1. No outside display of merchandise or equipment can be left outside the
building after normal working hours.
2. No required parking can be used for outside display.
3. No access ways can be blocked.
4. All trash areas must be site proof.
5. Normal working hours 8:00 a.m. unti16:00 p.m.
6. Exterior lighting must be located on the premises so that the lighting will not
"'rr- become a nuisance to traffic or to adjacent business.
7 . No display will be allowed on public sidewalks or public right-of-way.
8. Parking must be adequate for employees and customers per Zoning
Ordinance requirements.
9. All merchandise and equipment must be displayed in neat and orderly
manner per Code Enforcement officials.
10. Parking adequate if no more than 2/3 building area is used for business.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I: That the following described property, to-wit:
East 20 feet of Lot 2 and Lots 3, 4, 5, and 6 amended Plat of M. L.
Thompson, 3rd Addition, 512 E. Broadway be, and the same hereby is granted a Special
Permit Use permitting the usage of an Accessory Display with special conditions as

1. No outside display of merchandise or equipment can be left outside the

SECTION II: That all Ordinances or part of Ordinances in conflict herewith are
hereby repealed.
SECTION III: That it has been found and determined by the City Council of the
City of West Memphis, that this property is presently being used as limited outdoor display
and made available for public use and immediate passage of this Ordinance is necessary for
the development and use of said property for the purpose of an Accessory Display. That
the Council is of the opinion that the passage of the same is necessary for the growth and
expansion of the City of West Memphis, Arkansas, and in the interest of the public health,
peace, safety and welfare of the City of West Memphis and the inhabitants thereof.
Therefore, an emergency is hereby declared to exist and this Ordinance shall take effect
and be in full force and effect immediately upon its passage and approval.
