AN ORDINANCE TO AMEND SECTION 5.28.040 OF THE WEST
MEMPHIS MUNICIPAL CODE TO REQUIRE PROPERTY RECEIVED
IN PAWN TO BE HELD FOR FOURTEEN (14) DAYS, AND FOR OTHER
PURPOSES.
WHEREAS, the West Memphis City Council finds that the time period that pawned
property should be held should be increased to fourteen (14) days to permit sufficient time for the
Police Department to investigate claims of stolen property and for the owner of any stolen
property to make arrangements for its return;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, THAT:
SECTION 1. Section 5..28.040 of the West Memphis Municipal Code is hereby
amended to read as follows:
Removal of Property.
No property bought or received in pawn shall be sold, leased or otherwise removed from
the pawnbroker or dealer's place of business, except for redemption by the person who
placed the property in pawn, for a period of fourteen (14) days after the record of
acquisition as required in this chapter has been delivered to the chief of police or his/her
designee.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of any such conflict.
