A RESOLUTION CERTIFYING THE REMOVAL OF CERTAIN SIGNS AND
POLES FROM VACANT PROPERTY LOCATED WITHIN THE CITY OF
WEST MEMPHIS.
WHEREAS, section seven (7) of the West Memphis Sign Ordinance 1484
provides a procedure for the City Council to remove signs and sign poles from private
property; and
WHEREAS, as provided by section seven (7) of the West Memphis Sign
Ordinance 1484, notice of immediate removal of signs and sign poles from private
property is provided by mailing a certified copy of the resolution to the owner or owners,
if their whereabouts are known, or to their last known address, giving (10) days written
notice to remove the signs and sign poles from the property; and
WHEREAS, as provided in section seven (7) of the West Memphis Sign
Ordinance 1484 the signs and sign poles may be removed by the building inspector or a
duly designated representative if the problem has not abated within (10) days after proper
notification to the property owner or owners; and
WHEREAS, if the city has any net costs in removal of any signs and sign poles,
the city shall have a lien placed on the property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT, the property located in the
City of West Memphis and described in Exhibit "A" attached hereto and incorporated
herein by reference is hereby declared to be a nuisance for the reasons therein set forth.
BE IT FURTHER RESOLVED, THAT, if the signs and sign poles located in
the City of West Memphis, described in Exhibit "A" attached hereto, have not been
removed within (10) days of proper notification to the property owner or owners, by
certified mail, the building inspector or his duly designated representative is authorized
and directed to remove the signs and sign poles and to cause a lien to be placed on the
property for the net cost incurred by the city for the removal of said signs and sign poles.
