AN ORDINANCE TO WAIVE COMPETITIVE $IDDING FOR BLEACHERS,
BENCHES AND GUARD RAILS FOR USE BY THE PARKS AND RECREATION
DEPARTMENT AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Parks and Recreation Department
was in need of purchasing bleachers, benches and guard rails for
parks located in West Memphis and t ime was of the essence in
order to have these items in place and to have the park
facilities ready for use;
NOW, THEREFORE, BE IT ORDAINBD BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
items to be used by the City of West Memphis and the Parks and
Recreation Department:
Six 5 row bleachers, one 10 row bleacher, two portable
_ benches, and one set of guard rails purchased from Howard
Sommer Company in the total amount of $10,5'79.44
2. Competitive bidding is being waived for the reason
that time was of the essence in order to have these items in
place and to have the park facilities ready for use, and the
Parks and Recreation Department did obtain price quotes from
four providers of these items, those being American Pro, Howard
Sommer Company, Belson Manufacturing Company, and Summitt
Supply. The lowest price quote was provided by Howard Sommer
Company, from whom the items have been obtained.
