WHEREAS, the West Memphis Police Commission at the
meeting on April 12, 1983, discussed the new D.W.I. Law,
whereby a Person who is financially unable to pay fines,
fees or costs while having been convicted of D.W.I. may
be ordered by the Court to perform public service work of
such type and for such duration as deemed appropriate; and,
WHEREAS, it is believed by the City Council of the
City of West Memphis that such a program has merit and could
be instituted on a trial basis under such guidelines as
ordered by the Municipal Court as a Pilot Program; and,
WHEREAS, the City is in urgent need to have additional
help to maintain the ball fields for the West Memphis Recreation
Department and to perform other duties of the City where no
expense is involved; and,
WHEREAS, it is recommended that such persons performing
public service work could report to a Department Head and sign
in and out with the Department Head and remain home overnight
without being incarcerated, thereby reducing potential liability
and expense for feeding and housing;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST b1EMPHIS, ARKANSAS, THAT The Honorable Lindsey
Fairley, Judge of the West Memphis Municipal Court give due
consideration to establishing a program whereby persons who
are financially unable to pay fines, fees, and costs of D.W.I.
cases be designated some type of public work under the guidelines
recommended by the City Council. ,~~;
