RESOLUTION FIXING A DATE FOR HEARING THE PETITION OF
REBECCA TAYLOR HEMENWAY, LOWELL W. TAYLOR, JR., AND
CARRA L. TAYLOR, HIS WIFE, EDWARD P. CONNELL, TRUSTEE,
AND EUGENE WOODS, TRUSTEE,FOR VACATING A UTILITY
EASEMENT DESCRIBED AS TRACT IV AND TRACT V IN A DEED
OF EASEMENT DATED AND FILED FOR RECORD DECEMBER 22,
1972, AND APPEARING OF RECORD IN BOOK 471 AT PAGE 346
OF THE RECORDS OF CRITTENDEN COUNTY, ARKANSAS.
WHEREAS, Rebecca Taylor Hemenway, Lowell W. Taylor, Jr.,and
Carra L. Taylor, his wife, Edward P. Connell, Trustee, and Eugene
Woods, Trustee, filed a Petition with the City Council of the City
of West Memphis, Arkansas, requesting the vacation of the utility
easements described as Tract IV and Tract V in that certain deed
of easement dated and filed for record on December 22, 1972, and
appearing of record in Book 471 at Page 346, of the Records of
Crittenden County, Arkansas; and,
WHEREAS, said Petition appears to be in proper form and to be
signed by all of the owners on whose property the easement extends;
and,
WHEREAS, it appears that said utility easements herein
described have not actually been used by the public as a utility
easement for a period of more than five years and that a date should
be fixed for the hearing of such Petition;
NOW, THEREFORE, BE IT RESOLVED:
1. That the 19th day of May , 1983, be and the same
is hereby fixed as the date for hearing the Petition aforesaid.
2. That the City Clerk give notice of such meeting by
publication once a week for two consecutive weeks in some newspaper
published in the County and having a general circulation in the
City of West Memphis, Arkansas. The said notice shall:
(a) State the names of the person or persons
who signed by Petition;
(b) Describe the utility easement to be vacated;

(c) Advise all persons that on the date above
named the City Council of the City of West
Memphis, Arkansas, will hear and determine
whether the utility easement shall be vacated.
