The following resolution was introduced by
Alderman L. Shelton , who moved its adoption:
RESOLUTION FIXING THE DATE FOR HEARING THE PETITION
OF JAMES R. PUGH AND VERNON D. TURK, JR. FOR VACATING
A UTILITY EASEMENT.
WHEREAS, James R. Pugh and Vernon D. Turk, Jr., filed
a Petition with the City Council of the City of West Memphis
Arkansas requesting the vacation of the utility easement
more particularly described as follows:
The West 75 feet of the South Half of Lot 8
in Block 7 of the Compress Subdivision to the
City of West Memphis, Crittenden County,
Arkansas; and
WHEREAS, said petition appears to be in proper form and
to be signed by all of the owners on whose property the easement
extends; and
WHEREAS, it appears that said utility easement herein
described has not actually been used by the public as a utility
L' easement for a period of more than five years and that a date

should be fixed for the hearing of said Petition;
NOW, THEREFORE, BE IT RESOLVED:
1. That the ~' t~ _ day o f j) L ~ U ~~ 19 8 3 , be and the
same is hereby fixed as the date for hearing the Petition
aforesaid.
2. That the City Clerk give notice of such meeting by
publication once a week for two consecutive weeks in some
newspaper published in the County and having a general
circulation in the City of West Memphis, Arkansas. The
said notice shall:
(a) State the name of the person or persons
who signed the Petition;
~ (b) Describe the utility easement to be vacated;
(c) Advise all persons that on the date above
~,. named the City Council of the City of West
Memphis, Arkansas shall hear and determine
whether the utility easement shall be vacated.
