WHEREAS, there has been Bled with the City Council of the
~ City of,West Memphis, Arkansas, a petition to vacate the sidewalk
easement granted to the City of West Memphis, Arkansas, by Easement
~,,,,, dated November 15, 1967, filed for record in the office of the
Recorder of Crittenden County, Arkansas, November 22, 1967, and
therein recorded in Book 412 at page 54, whereby there was granted
to the City of West Memphis, Arkansas, an easement and right of
way for a sidewalk to be built and maintained by the City of
West Memphis, Arkansas, said easement granted being described as
follows, to wit:
Three feet north and three feet south of the center line of
that unnamed street lying west~of the west line of 28th Street
and east of the east line of 27th Street, lying north of Beatty
Street and south of Church' Street as shown by the recorded
plat of Second Rich Eastern Addition to West Memphis, Arkansas,
recorded in Plat Book 1 at page 273 in the office of the
Recorder of Crittenden County, Arkansas, and abutting Lots
10 and 11 in Block 11 and Lots 1 and 21 in Block 13 of the
said Second Rich Eastern Addition, which unnamed street was
abandoned by Ordinance No. 542 of the Ordinances of the City
of West Memphis, Arkansas; and
WHEREAS, it is necessary that the City Council fix a day for
the hearing of such petition and to direct that the City Clerk give
notice of such meeting by publication once a week for two consecu-
tive weeks in some newspaper published in the county and having
a general circulation in the City of West Memphis, Arkansas: NOW,
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:

PETITION TO VACATE SIDEWALK EASEMENT
The undersigned hereby petition the City of West Memphis,
Arkansas, to vacate the sidewalk easement granted to the City of
` West Memphis, Arkansas, by Easement dated November 15, 1967, filed
for record in the office of the Recorder of Crittenden County,
Arkansas, November 22, 1967, and therein recorded in Book 412 at
page 54, whereby there was granted to the City of West Memphis,
Arkansas, an easement and right of way for a sidewalk to be built
and maintained by the City of West Pdemphis, Arkansas, said easement
granted being described as follows, to wit:
Three feet north and three feet south of the center line of
that unnamed street lying west of the west line of 28th Street
and east of the east line of 27th Street, lying north of Beatty
Street and south of Church Street as shown by the recorded
plat of Second Rich Eastern Addition to West Memphis, Arkansas,

The undersigned are the owners of all of the lots abutting
said sidewalk easement.
That there is attached hereto as Exhibit A a copy of that por-
tion of the Plat filed in the office of the Recorder of Cf~ittenden
County, Arkansas, which shows the easement to be vacated, together
with the lot and block numbers of each lot which abuts upon the
easement to be vacated.
There is also attached as Exhibit B, a copy of Ordinance No.
542 and as Exhibit C, a copy of the easement deed.
That the sidewalk built by the City of West Memphis upon said
easement has become unusable and grown up in weeds and the City no
' longer maintains said sidewalk and it should be closed and abandoned.
Wherefore, petitioners pray that the City Council of the City
of West Memphis, Arkansas, at its next regular or special meeting,
fix a day for the hearing of this petition and direct the City Clerk
to give notice of such hearing as required by la~,;~~j~~

final hearing that the above described easement be vacated and all
rights of the City of West Memphis and of the public generally
therein be released, vacated and abandoned.

AN ORDINANCE VACATING AN
UNNAMED STREET LOCATED
IN SECOND RICH EASTERN
ADDITION TO WEST MEMPHIS
Whereas, a petition was duly filed with the City Council
of the city of West Memphis, Arkansas, on the 2nd day of November,
1967, asking the city council to vacate and abandon all that
!portion of the street described as follows;
All of that unnamed street lying West of
the West line of 28th Street and East of
the East line of 27th Street, lying North
of Beatty Street, and South of Church Street
as shown by the recorded plat of Second
Rich Eastern Addition to West Memphis located
in the East one-half (E~) of Section Eight,
Township Six North (T6N), Range Nine East
(R9E) in Crittenden County, Arkansas, and
recorded in Plat Book 1, Page 273 in the
office of the Circuit Court Clerk and Ex-
Officio Recorder for Crittenden County,
Arkansas, and abutting Lots Ten (10) and
Eleven (11) in Block Eleven (11) and Lots •
One (l) and Twenty-One (21) of the said
Second Rich Eastern Addition to West Memphis,
Arkansas.
Whereas; after due notices as required•by ]aw, the co~,ncil~

has, at the time and place mentioned in the notice, heard all
persons desiring to be heard on the question and has ascertained
that the street or the portion thereof, hereinbefore described,
has heretofore been dedicated to public use as a street herein
described; has not been actually used by the public generally for
a period of at lease five years subsequent to the filing of the
plat; that all the owners of the property abutting upon the`

portion of the'street to be vacated have filed. with the'Council
their written consent to such abandonment; and that public interest
and welfare will not be adversely affected by the abandonment

Section 1. The City of West Memphis, Arkansas, hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to the street described
as follows:
All of that unnamed street lying West of

of Beatty Street and South of Church Street
as shown by the recorded plat of Second
Rich Eastern Addition to West Memphis located
in the East one-half (E~) of Section Eight,

recorded in Plat Book 1, Page 273 in the

easement lying in Lot 22, Avaondale Commercial Subdivision to
the City of West Memphis, Arkansas, as shown by plat recorded
in Plat Book 2, Page 33O,in the office of the Circuit Court
Clerk & Ex-Officio Recorder of Crittenden County, Arkansas,
an easement and right of way for a utility easement to be
built and maintained by the City of West Memphis, Arkansas,
said easement granted being described as follows, to wit:
Beginning at a point 5.0 feet south of and 300.0 feet
east of the northwest corner of said Lot 22, thence
east along a line parallel to and 5.0 feet south of the
north line of said Lot 22 a distance of 500.0 feet. The
above described line being the centerline of a 10.0 foot
utility easement lying in Section 1, Township 6 North,
Range 8 East, Crittenden County, Arkansas.
All persons are hereby notified and advised that the City
Council of the City of West Memphis, Arkansas, will hear said
petition and determine whether the utility easement hereinabove
specifically described shall be vavated at a meeting of said
Council to be held on the 6th day of September, 1984 at 2:00
