RESOLUTION N0.
WHEREAS, a lawsuit has been filed against the West
Memphis Utility Commission for damages in a considerable
amount for alleged violations of the Environmental Protection
Act; and,
WHEREAS, it has been determined by the West Memphis
Utility Commission that the chances to win such a lawsuit is
remote; and,
WHEREAS, the Environmental Protective Agency has
agreed to settle the suit for $30,000.00 and to assist the
City in revising some of the Administrative Orders;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF WEST MEMPHIS, ARKANSAS, that the City Council
approve the payment to the Environmental Protective Agency
of $30,000.00 with a condition that payments be extended over
considerable time and that the Environmental Protective Agency
assist the City in agreeing to revision of certain administrative
orders;
