ORDINANCE NO . ~/6a 3
AN ORDINANCE TO AMEND SECTION 21 OF ORDINANCE 393 TO PROVIDE
AN INCREASE IN THE PENALTY FOR VIOLATIONS TO AN AMOUNT NOT
EXCEEDING FIFTY DOLLARS.
WHEREAS, Ordinance 393, the anti-litter ordinance, was
adopted by the West Memphis City Council in 1960 and provided a
penalty for violations of a fine in an amount not exceeding
twenty-five dollars; and
WHEREAS, the penalty provision of Ordinance 393 has not
proven to be an effective deterrent to violations of the
provisions of Ordinance 393 and should be increased;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Section 21 of Ordinance 393 is hereby amended to
read as follows:
Section 21. PENALTIES Any person violating any of the
provisions of this Ordinance shall be deemed guilty of a
misdemeanor and upon conviction thereof shall"`be fined in an
amount not exceeding Fifty Dollars ($50.00). Each day such
violation is committed or permitted to .continue shall
constitute a separate offense and shall be punishable as such
hereunder.
SECTION 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
