RESOLUTION N0. ~~
WHEREAS, the West Memphis City Council by Resolution
No. 707, retained Bond Underwriters, Bond Counsel, and
Mr. Dave Wilson, Attorney, North Little Rock, Arkansas, to
assist the City Attorney as needed in negotiations with AP&L
in the acquisition of a percentage interest in coal generating
plants; and,
WHEREAS, it was necessary to terminate the services of
Mr. Dave Wilson when negotiations with AP&L slowed down due to
the expense involved, a total sum of $19,210.53 having been
paid Mr. Wilson within an eightteen (18) month period; and,
WHEREAS, the West Memphis Utility Commission has
rehired Mr. Wilson to assist in AP&L acquisition; and,
WHEREAS, the law states that all legal matters for the
City of West Memphis be under the elected City Attorney;
THEREFORE, B~ IT RESOLVED, by the City Council of the
City of West Memphis, Arkansas that all negotiations with AP&L
in acquisitions of coal generating plants. be under the control
of the City Attorney;and,
THEREFORE BE IT FURTHER RESOLVED that the West .Memphis
Utility Commission be instructed to request the City Attorney
to employ and terminate such additional counsel as is needed
for acquisition procedures with AP&L.
