AN ORDINANCE TO AMEND ORDINANCE 1258 REGARDING ZONING
REGULATIONS FOR THE CITY OF WEST MEMPHIS, ARKANSAS, AND
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, the Planning Commission of the City of West Memph~.'s,
Arkansas, has prepared amendments to Ordinance 1258, which adopted
zoning regulations and an official zoning map for the City of West
Memphis, Arkansas; and
WHEREAS, not fewer than three (3) copies of said amendments to
Ordinance 1258 have been on file in the office of the City Clerk in
the West Memphis City Hall and will continue to be on file at all
times for public inspection and review; and
WHEREAS, after a public hearing upon due notice and
publication, pursuant to Article IX, Section 5, 6 and 7 of the
zoning regulations adopted by Ordinance 1258, the Planning
Commission has approved and recommended for adoption the proposed
amendments of the zoning regulations adopted by Ordinance 1258;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
~ OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Article III, Section 1 (B)(2) of the zoning
regulations adopted by ordinance 1258, as amended, is hereby
amended, to read as follows:
Community Facilities and Related Uses R-1 R-2 R-3 R-4
Hospital, Health Center, Institution SP SP SP
for aged or children, Assisted Care
Facility
SECTION 2. Article III, Section 2 (B)(3) of the zoning
regulations adopted by ordinance 1258 as amended, is hereby
amended, to read as follows:
Community Facilities and Public Utilities O-1 C-1 C-2
Hospital, Health Center, Institution SP X X
for aged or children, Assisted Care
Facility
SECTION 3. Article III, Section 3 (B)(3) of the zoning
regulations adopted by ordinance 1258, as amended, is hereby
amended to add the following designation to allow Hospital, Health
Institution for aged or children, Assisted Care Facility in
Center,
I-1 Limited Industrial District with a Special Permit Use:
Community Facilities and Public Utilities I-1 I-2
Hospital, Health Center, Institution SP
for aged or children, Assisted Care
Facility
SECTION 4. Article X, Section 2, of the zoning regulations
adopted by ordinance 1258 is hereby amended to add the following
definition:
Assisted Care Facility: Any premises where more than three
(3) persons are lodged and provided with assistance for day to
day living.
SECTION 5. All ordinances or parts of ordinances in conflict
`, herewith are hereby repealed.
SECTION 6. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there exists an urgent need to amend the text of the
Zoning Ordinance as adopted by Ordinance 1258, as amended, to
provide for the orderly growth and development of the City of West
Memphis as proposed by the Planning Commission, an emergency is
hereby declared to exist, and this ordinance being necessary for
the preservation of the public peace, health, safety and welfare of
the citizens of West Memphis, Arkansas, it shall be in full force
and effect from and after the date of its passage and a$,proval.
