AN ORDINANCE GRANTING A SPECIAL PERMITTED USE FOR
PARCEL M-2-A OF THE DIVISION OF THE HALL PROPERTY
IN THE SE 1/4 OF SECTION 13, TOWNSHIP 6 NORTH, RANGE 8
EAST, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES
WHEREAS, application was made to the City Planning Commission
to allow a special permitted use of the hereinafter described lands
a~ for an Assistant Care Residential Facility in an I-1 Limited

+' Industrial zoning district per Zoning Ordinance 1258, as amended; and
WHEREAS, after notice of said hearing published for the time
and in the manner as provided by Ordinance No. 1258, the matter was
heard on December 16, 1993, by the City Planning Commission and upon
due consideration thereof the Planning Commission recommended that
said application be granted provided the following stipulations were
agreed upon by the Applicant, to wit:
1. Trash area to be site proof and oriented away from the
street;
2. that proper fencing and landscaping be planted abutting all
other properties in this area;
3. that exterior lighting be located to reflect away from
residential and industrial districts;
4. that there be no excessive or unusual noise, odor or
vibration exceeding the general level of noise, odor or vibration
emitted by uses adjacent to or immediately surrounding the site;
5. that there be no storage of goods or equipment outside the
building;
6. that no loading and unloading area be oriented on the front
elevation of structure;
7. the number of residents living at said facility should not
exceed a maximum of 60; and
8. that there must be on-site parking for all employees,
visitors, etc.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS;
SECTION I; That the following described property, to wit;
Parcel M-2-A of the division of the Hall property in the
SE 1/4 of Section 23, Township 6 North, Range 8 East, being
located at approximately ~ South Woods Street, West

Memphis, Arkansas,
be, and the same is hereby, granted a Special Permitted Use allowing
and permitting the use of the building to be constructed thereon to
be used for an Assistant Care Residential Facility .
SECTION II: That all Ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION III: EMERGENCY CLAUSE: It is found and determined by
the City Council that this property is in the process of development
and that this ordinance is necessary for the preservation of'the
public peace, health and welfare of the City and the inhabitants
thereof and that there is a shortage of such residential care
facilities and there is an immediate necessity therefor; therefore,
an emergency is hereby declare to exist and this ordinance shall be
in full force and effect from and after its passage and approval
