RESOLUTION NO. 876
WHEREAS, a matter has arisen between the City of
West Memphis and Southland Racing Corporation concerning
the responsibility for the repairs to the North Ingram
Boulevard Bridge; and,
WHEREAS, Southland Racing Corporation denied any
responsibility for the damage to said bridge, but the matter
has been resolved amicably between the City of West Memphis
and Southland Racing Corporation; and,
WHEREAS, Southland Racing Corporation is having said
bridge repaired; and,
WHEREAS, Southland Racing Corporation desires a Release
for any claim which the City of West Memphis may ,have against
it regarding the bridge, and to evidence the receipt of the
consideration by the City of West Memphis for said repairs, it
has issued its check in payment of the repairs to both the
City of West Memphis and the contractor;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
That in order to settle this matter and evidence the
receipt of consideration by the City of West Memphis, the
Mayor is hereby authorized and directed to endorse said check
on behalf of the City of West Memphis to the contractor, and
to execute such Release as may be necessary upon the completion
of the repairs to said bridge, provided that this Resolution
shall not become effective until proper inspection of the bridge
is made by some official representing the State of Arkansas,
and that the bridge be declared safe for normal traffic for
everyday vehicles.
