AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF
107.5 ACRES OF SURPLUS LAND FROM THE ARKANSAS POWER AND LIGHT
COMPANY FOR THE WEST MEMPHIS FLOOD PROJECT AND FOR OTHER
PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations and where
such procedure is deemed not feasible or practical; and
~'"` WHEREAS, the City of West Memphis is desirous of purchasing
107.5 acres of surplus land as described in the attached legal
description from AP&L for the Flood Protection Project; and
WHEREAS, AP&L is willing to sell the property; and
WHEREAS, the City and AP&L both find acceptable the McCarley's
appraisal of $3,000.00 an acre; and
WHEREAS, the City and AP&L agree to split the $3,000.00
appraisal cost and to deduct AP&L's share from the final payment
that the City makes to AP&L; and
WHEREAS, AP&L has agreed to allow the City to defer payment
until March 31, 1994; and
WHEREAS, this surplus land is the only site suitable for use
for the Flood Project and is available from only one source and
competitive bidding under such circumstances would not be feasible
or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the purchase of
AP&L's 107.5 acres land.
2. The Mayor and the City Clerk are hereby authorized to
execute any and al l documents pertaining to the purchase of R ~ ~E ~~
