AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF A NEW FIRE TRUCK, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible or
practical; and
WHEREAS, there are many items necessary for the City's use where competitive
bidding is deemed not feasible or practical; and
WHEREAS, the City of West Memphis and the West Memphis Fire Department are in
need of purchasing a new fire truck and Pro-Fire Equipment, LLC., has quoted a price for a
Pierce demonstrator at substantial savings, and competitive bidding under such circumstances
would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City,
described as follows:
The purchase of a new fire truck from Pro-Fire Equipment, LLC., for the price of

We at Pro-Fire Equipment are proud to have the opportunity to present your department
with the following Pierce demonstrator for $289,427.00. It is available for delivery from
the Daytona racetrack this month; your requested changes will be made at our Bradenton
service facility prior to delivery. This pumper features the latest innovations in
firefighting technology. The truck includes: a 2007 Cummins 425 engine, Allison
automatic transmission, air conditioning, seating for six, Whelen LED light package,
1000 gallon poly tank, 1250 gpm Waterous pump, Foam Pro 1600 foam system, Extenda
Light scene lights and Honda generator. The truck is a demonstrator, so availability and
pricing is on a first come first serve basis. We meet all of the enclosed specifications.
Pierce is offering a 2 year bumper to bumper warranty if we can have the truck shipped
by April 1, 2011. In order for us to meet this deadline we would need to have a Purchase
order before March 9, 2011. We would like to thank you for this opportunity to do
