AN ORDINANCE ACCEPTING THE ANNEXATION OF CERTAIN TERRITORY
TO THE CITY OF WEST MEMPHIS, ARKANSAS, AND MAKING SAME A
PART OF THE CITY OF WEST MEMPHIS, ARKANSAS, AND ASSIGNING
SAME TO WARD
WHEREAS, a petition was filed with the County Clerk of
Crittenden County, Arkansas, by the majority of the real estate
owners of the hereinafter described territory praying that said
territory be annexed to and made a part of the City of West
Memphis, Arkansas; and
WHEREAS, on the ~~ day of APRIL 199, the
County Court of Crittenden County, Arkansas, found that the
petition was signed by a majority of the real estate owners in
said territory; that said territory was contiguous to and
adjoining the present corporate limits of the City of West
Memphis, Arkansas; that an accurate plat or map of said
territory had been filed with and made a part of said petition;
that proper notice had been given for the time and in the
manner prescribed by law, and that all things pertaining
thereto had been done in the manner prescribed by law, and that
said lands and territory should be annexed to and made a part
of the City of West Memphis, Arkansas, subject to the
acceptance of same by the City Council of the City at the
proper time, as provided by law; and
WHEREAS, the time fixed by law for appealing from said
Order of Annexation made by the County Court has expired and no
appeal has been taken from said Order.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
Section 1. The following described lands and territory
contiguous to and adjoining the City of West Memphis, Arkansas,
be and the same is hereby accepted as annexed to and made a
part of the City of West Memphis, Arkansas:
A 113.2 acre tract of land lying in the SW4 of Section 15
and the NW4 of Section 22, T-6-N, R-8-E, Crittenden
County, Arkansas and being more particularly described as
follows:
Commencing at the center of said Section 15, thence South
a distance of 660.0 feet to the point of beginning, thence
continue South a distance of 590.4 feet, thence West 898.0
feet, thence South a distance of 4990.79 feet to a point
on the North right-of-way line of the Chicago-Rock Island
& Pacific Railroad, thence S76°16'16"W a distance of
1544.12 feet, thence North a distance of 6607.65 feet
computed (call-6502.50 feet) to a point on the North line
of the SW; of Section 15, thence East a distance of 450.0
feet, thence South a distance of 4020.0 feet - computed
(call-4015.0 feet), thence West a distance of 50.0 feet,
thence South a distance of 1800.0 feet, thence East a
distance of 800.0 feet, thence North a distance of 1800.0
feet, thence East a distance of 120.0 feet, thence North
a distance of 3060.0 feet, thence East a distance of 600.0
feet, thence North a distance of 300.0 feet, thence East
a distance of 478.0 feet to the point of beginning
containing 113.2 acres more or less.
Section 2. The above described territory shall be
annexed to and made a part of Ward ONE of the City of West
Memphis, Arkansas, and the same shall henceforth be a part of
said Ward as fully as existing parts of said Ward.
Section 3. The above described territory is currently
zoned I-1 in accordance with the extraterritorial zoning
authority of the City of West Memphis and shall be annexed to
the City of West Memphis with the zoning designation of I-1 as
set out in the zoning ordinances of the City of West Memphis.
