AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR SEWER REPAIRS ON
10TH STREET AND ON WINCHELL STREET, DECLARING AN EMERGENCY AND
FOR OTHER PURPOSES.
WHEREAS, A.C.A. § 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed
not feasible or practical; and
WHEREAS, the City of West Memphis and the West Memphis Utility
Commission are in urgent need of repairing sewer facilities located
at 10th Street and at Winchell Street in West Memphis and time is
of the essence to protect the City sewer ystem and to maintain
adequate sewer services; and
WHEREAS, the sewer facilities to be repaired on 10th Street
will require the services of a professional contractor and the
sewer facilities to be repaired on Winchell Street may be capable
of being repaired by the City but, depending upon the extent of
repairs necessary, may require the assistance of a professional
contractor; and
WHEREAS, the total amount of both repair jobs is estimated at
a cost of $70,000, with any portion of such amount not required for
the repairs to sewer facilities on 10th Street to be appropriated
for the repairs on Winchell Street, if necessary;
NOW , THEREFORE , BE I T ORDAINED BY THE C I TY COUNC I L OF THE C I TY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
items to be used by the City of West Memphis and the West Memphis
Utility Commission:
Repairs for sewer facilities on 10th Street and on Winchell
Street in the amount of $70,000 with any portion of such
amount not required for the repairs on 10th Street to be
appropriated for the repairs on Winchell Street, if necessary.
2. Competitive bidding is being waived for the reason that
time is of the essence in order to protect the City sewer system
and to maintain adequate sewer services to the citizens of West
Memphis.
3. EMERGENCY CLAUSE. It having been found and determined by
the City Council of the City of West Memphis, Arkansas, that there
is an urgent need by the City of West Memphis and the West Memphis
Utility Commission to repair sewer facilities at 10th Street and at
Winchell Street in order to protect the City sewer system and to
maintain adequate sewer services to the citizens of the City and
that time is of the essence, an emergency is hereby declared to
exist, and this Ordinance, being necessary for the preservation of
the public peace, health, safety and welfare of the citizens of
West Memphis, Arkansas, shall be in full force and effect from and
after the date of its passage and approval.
