ORDINANCE NO. 2Z 78
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
PURCHASE OF RIGHT-OF-WAY DEBRIS REMOVAL SERVICES,
DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 authorizes the waiving of
competitive bidding in exceptional situations where competitive bidding is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis is in need of acquiring aRight-of--Way Debris
Removal services as a result of the recent storm damage in the city; and
WHEREAS, the City Council determines that competitive bidding should be waived for
the reason that the large amount of vegetative debris resulting from the recent storms in the city
is creating potential health and safety issues for the citizens of West Memphis and the debris
must be removed as soon as possible to alleviate the potential health and safety concerns and
competitive bidding under such circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS THAT:
SECTION 1. Competitive bidding is hereby waived for the acquisition of Right-of--Way
Debris Removal services, at a total cost of $ 42.00 per cubic yard for an estimated quantity of
5000 cubic yards totaling $210,000.00. This service to be provided by Crisp Contractors, Inc.
SECTION 2. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 3. EMERGENCY CLAUSE. It having been found and determined by the
City Council of the City of West Memphis, Arkansas, that recent severe storms in the city have
resulted in a large amount of vegetative debris which has accumulated in the right-of--ways

creating health and safety issues for the citizens of the city and an urgent and immediate need

ordinance being necessary for the preservation of the peace, health, safety and welfare of the
citizens of West Memphis, Arkansas, shall be in full force and effect from and after the date of
its passage and approval.
