AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF A
USED FORKLIFT FOR THE SANITATION DEPARTMENT'S RECYCLING FACILITY
AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where such
procedure is deemed not feasible or practical; and
WHEREAS the Sanitation De artment o erates a rec clip

facility that produces large bales of recycled plastic; and
WHEREAS, the Department is in need of a means to move the
bales from the baling machine and to load them onto trucks; and
WHEREAS, the facility produces less that five bales a week;
and
WHEREAS, it would be uneconomical to bid and purchase a new
forklift for such infrequent use; and
WHEREAS, the Shop Superintendent has located and inspected a
used forklift that has been rebuilt; and
WHEREAS, the forklift is available from a known dealer and has
been used at the recycling facility on a trial lease basis and has
successfully performed as needed and competitive bidding under such
circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the purchase of a
used forklift from Grady W. Jones Company at a cost of $7,000.00.
