1638i "s ORDINANCE NO. /63g AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF A USED 66 HORSEPOWER TRACTOR AND MOWER FOR USE BY THE STREET DEPARTMENT AND FOR OTHER PURPOSES. WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical; and WHEREAS, the City, with the recent completion of the flood control project, has added over four miles of ditches and over 50 acres of land that needs to be mowed; and WHEREAS, the Street Department does not have enough mowing equipment onhand to maintain the additional right-of-ways; and WHEREAS, the afore mentioned tractor and mower were leased in 1993 as the City was determining the type and size of equipment that was needed; and WHEREAS, the afore mentioned tractor and mower has been leased again in 1994 for the maintenance work and is proving to be very capable of performing the necessary work; and WHEREAS, it is in the vital interest of the citizens of West Memphis to have the flood protection ditches adequately mowed to ensure that the ditches function to the full extent that they were designed to; and WHEREAS, a used 66 horsepower tractor and mower is available from a known dealer and has been leased previously by the City and has proven to be capable of performing the work as needed and competitive bidding under such circumstances would not be feasible or practical; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY (~fCE1VED CITY CLERK QFFIC~E ©ATE S 3~ q ® q:3Qacu~ OF WEST MEMPHIS, ARKANSAS: 1.
