AN ORDINANCE TO AMEND ARTICLE III, SECTION 2 OF THE ZONING
REGULATIONS ADOPTED BY ORDINANCE 1258, AS AMENDED, TO ALLOW
NURSERY, PLANTS AND STOCK OUTDOOR RETAIL SALES IN C-1
DISTRICTS BY SPECIAL USE PERMIT, AS AMENDED, DECLARING AN
EMERGENCY AND FOR ALL PURPOSES.
WHEREAS, after public hearing upon due notice and publication,
pursuant to Article IX, Section 5, 6, and 7 of the zoning
regulations adopted by Ordinance 1258, as amended, the Planning
Commission has approved and recommended for adoption the proposed
amendment to the zoning regulations adopted by Ordinance 1258, as
amended, to allow nursery, plants & stock outdoor retail sales in
the C-1 District by Special Use Permit;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Article III, Section 2 (B-5) of the zoning
regulations adopted by Ordinance 1258, as amended, is hereby
amended to add the following designation to allow a nursery,
plants, and stock outdoor retail sales in the following C-1
District by Special Use Permit:
Permitted Uses Zoning District
Nursery, plants, and 0-1 C-1 C-2
stock outdoor retail S.P.
sales
SECTION 2. EMERGENCY CLAUSE. It having been found and
determined by the City Council of the City of West Memphis,
Arkansas, that there is an urgent need by the City of West Memphis
to proceed with amending the zoning regulations to allow a nursery,
plants, and stock outdoor retail sales in C-1 Commercial District
with Special Use Permit, an emergency is hereby declared to exist,

and this Ordinance being necessary for the preservation of the
public peace, health, safety and welfare of the citizens of West
Memphis, Arkansas, shall be in full force and effect from and after
the date of its passage and approval.
SECTION 3. All ordinances or part of ordinances in conflict
herewith are hereby repealed.
