1677ORDINANCE NO. ~b~~ AN ORDINANCE TO AMEND ARTICLE III, SECTION 1 AND ARTICLE V, SPECIAL PROVISIONS, SECTION 5 OF THE ZONING REGULATIONS ADOPTED BY ORDINANCE 1258 AS AMENDED, AND FOR OTHER PURPOSES. WHEREAS, after public hearing upon due notice and publications, pursuant to Article IX, Sections 5, 6, and 7 of ,the zoning regulations adopted by Ordinance 1258, as amended, the Planning Commission has approved and recommended for adoption the proposed amendments to the zoning regulations adopted by Ordinance 1258, as amended, to allow a school, nursery, or day care for children by Special Permit Use in a R-2 District subject to Article V, Paragraph D; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF WEST MEMPHIS, ARKANSAS: SECTION 1. Article III, Section 1 (B-2) of the zoning regulations adopted by Ordinance 1258, as amended, is hereby amended to add the following designation to allow a school, nursery or day care for children in the following Residential District by Special Use Permit: School, nursery or R-1 R-2 R-3 R-4 day care for children SP subject to Article V, Paragraph D. SECTION 2. Article V, Special provisions Section 5 of the zoning regulations adopted by Ordinance 1258 as amended is hereby amended to add the following subsection: D. Residential child care centers maybe located on a lot having not less than twenty thousand square feet (20,000 sq ft.) of area and fronting a collector street and designed and constructed with the character of a residential single family structure. This structure may or may not be the permanent residence of the operator. SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
